AN ACT to amend the public health law, in relation to requiring  general
  hospitals  to offer an anti-viral prophylaxis to high-risk infants for
  the prevention of respiratory syncytial virus

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new section
2805-v to read as follows:
  S 2805-V. PREVENTION  OF  RESPIRATORY  SYNCYTIAL  VIRUS  IN  PREMATURE
INFANTS.  IT  SHALL  BE  THE DUTY OF THE ADMINISTRATIVE OFFICER OR OTHER
DESIGNATED PERSON AT EACH FACILITY LICENSED  PURSUANT  TO  THIS  ARTICLE
CARING  FOR  NEWBORN INFANTS TO OFFER TO THE PERSON IN PARENTAL RELATION
TO A PREMATURE INFANT OR CHILD UNDER THE AGE OF  TWO  AND  AT  RISK  FOR
RESPIRATORY  SYNCYTIAL  VIRUS U.S. FOOD AND DRUG ADMINISTRATION APPROVED
MEDICATION FOR THE PROPHYLAXIS FOR RESPIRATORY SYNCYTIAL VIRUS (RSV) FOR
SAID INFANT OR CHILD. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY  IN
THE  CASE OF ANY INFANT OR CHILD WHOSE PARENT OR GUARDIAN IS A MEMBER OF
A RECOGNIZED RELIGIOUS  ORGANIZATION  WHOSE  TEACHINGS  AND  TENETS  ARE
CONTRARY  TO  RECEIVING  SUCH PROPHYLAXIS AND WHO NOTIFIES THE PERSON IN
CHARGE OF THEIR OBJECTION.
  S 2. This act shall take effect immediately.
