AN ACT to amend the public officers law, in relation to access to public
  agency records that are commercial enterprise trade secrets

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Paragraph (d) of subdivision 2 of section 87 of the public
officers law, as amended by chapter 289 of the laws of 1990, is  amended
to read as follows:
  (d)  are  trade  secrets or are submitted to an agency by a commercial
enterprise or derived from information obtained from a commercial enter-
prise and which if disclosed  would  cause  substantial  injury  to  the
competitive  position of the subject enterprise, PROVIDED THAT AN AGENCY
MAY PROVIDE ACCESS TO SUCH RECORDS OR  PORTIONS  THEREOF  WHICH  CONTAIN
INFORMATION  ABOUT MATERIALS, PROCESSES OR ACTIONS THAT MIGHT CAUSE HARM
TO THE PUBLIC HEALTH OR ENVIRONMENT;
  S 2. This act shall take effect immediately.

AN ACT to amend the public officers law, in relation to access to public
  agency records that contain information about materials, processes  or
  actions  that  may  cause  harm to the public health or safety, or the
  environment

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 89 of the public officers law is amended by adding
a new subdivision 10 to read as follows:
  10. UNLESS OTHERWISE PROHIBITED BY LAW, AN AGENCY MAY  PROVIDE  ACCESS
TO  RECORDS  DETERMINED  BY  SUCH  AGENCY  TO BE IN THE PUBLIC INTEREST,
INCLUDING, BUT NOT LIMITED TO RECORDS OR PORTIONS THEREOF  THAT  CONTAIN
INFORMATION ABOUT MATERIALS, PROCESSES OR ACTIONS THAT MAY CAUSE HARM TO
THE PUBLIC HEALTH OR SAFETY, OR THE ENVIRONMENT.
  S 2. This act shall take effect immediately.
