AN ACT to amend the general construction law, in  relation  to  defining
  "integrated pest management"

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general construction law is amended  by  adding  a  new
section 23-a to read as follows:
  S  23-A.  INTEGRATED PEST MANAGEMENT. THE TERM INTEGRATED PEST MANAGE-
MENT MEANS A DECISION MAKING PROCESS  FOR  PEST  CONTROL  THAT  UTILIZES
REGULAR  MONITORING  TO  DETERMINE  IF  AND  WHEN CONTROL IS NEEDED, AND
EMPLOYS  PHYSICAL,  MECHANICAL,  CULTURAL,  BIOLOGICAL  AND  EDUCATIONAL
TACTICS  TO  CONTROL  CONDITIONS THAT PROMOTE PEST INFESTATIONS AND KEEP
PEST POPULATIONS AT TOLERABLE DAMAGE AND ANNOYANCE LEVELS. SUCH DECISION
MAKING PROCESS SHALL ONLY CONSIDER THE  USE  OF  LEAST  TOXIC  PESTICIDE
CONTROLS  AS A LAST RESORT. THE OVERALL GOALS OF INTEGRATED PEST MANAGE-
MENT SHALL BE THE ELIMINATION OF THE UNNECESSARY USE OF  PESTICIDES  AND
THE REDUCTION OF THE USE OF ALL PESTICIDES.
  S 2. This act shall take effect immediately.
