AN ACT to amend the education law, in relation to the career development
and occupational studies program
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The education law is amended by adding a new section 4410-d
to read as follows:
S 4410-D. CAREER DEVELOPMENT AND OCCUPATIONAL STUDIES PROGRAM. 1. ANY
STUDENT WHO WAS ISSUED A CAREER DEVELOPMENT AND OCCUPATIONAL STUDIES
COMMENCEMENT CREDENTIAL PURSUANT TO 8 NYCRR 100.6(B), BUT WHO FAILED TO
EARN A REGENTS DIPLOMA SHALL BE AWARDED A CDOS DIPLOMA UPON GRADUATION
FROM HIGH SCHOOL.
2. ANY STUDENT WHO IS ELIGIBLE FOR AN INDIVIDUALIZED EDUCATION PROGRAM
(IEP) PURSUANT TO SECTION FOUR THOUSAND FOUR HUNDRED TWO OF THIS ARTI-
CLE, AND HAS COMPLETED A FIRST ROUND OF REGENTS TESTING IN TENTH GRADE,
SHALL BE RE-EVALUATED BY THE COMMITTEE ON SPECIAL EDUCATION TO DETERMINE
WHETHER SUCH STUDENT SHALL CONTINUE REGENTS TESTING OR BE PLACED IN A
CAREER DEVELOPMENT AND OCCUPATIONAL STUDIES PROGRAM.
S 2. This act shall take effect on the one hundred eightieth day after
it shall have become law, provided, however, that effective immediately,
the addition, amendment and/or repeal of any rule or regulation neces-
sary for the implementation of this act on its effective date is author-
ized to be made and completed on or before such effective date.
