AN ACT to amend the workers' compensation law, in relation  to  imposing
  penalties  on  third parties designated by employers for their failure
  to file required accident reports or keep required accident records

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision 4 of section 110 of the workers' compensation
law, as amended by chapter 635 of the laws of 1996, is amended  to  read
as follows:
  4.  An  employer,  OR  A  THIRD  PARTY DESIGNATED BY THE EMPLOYER, who
[refuses or neglects] FAILS to make a report IN A TIMELY  MANNER  or  to
keep  records as required by this section shall be guilty of a misdemea-
nor, punishable by a fine of not more than one thousand  dollars.    The
board  or  chair may impose a penalty of not more than two thousand five
hundred dollars upon an employer, OR A THIRD  PARTY  DESIGNATED  BY  THE
EMPLOYER, who [refuses or neglects] FAILS to make such report IN A TIME-
LY MANNER.
  S 2. This act shall take effect immediately.
