AN ACT to amend chapter 118 of the laws of 1969, relating to a  separate
  union free school district in the town of Greenburgh, in the county of
  Westchester, in relation to clarifying the authority of the Greenburgh
  North  Castle  Union  Free School District to lease certain properties
  and to expand its boundaries

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 2-a of Chapter 118 of the laws of 1969, relating to
a  separate union free school district in the town of Greenburgh, in the
county of Westchester, as amended by chapter 226 of the laws of 2010, is
amended to read as follows:
  S [2-a] 2-B.  Notwithstanding any other law, rule,  or  regulation  to
the  contrary,  in addition to the powers granted by section two of this
act, subject to the approval of the New York state education department,
the board of education shall be authorized to lease  properties  located
at  623  Blooming  Grove Turnpike, in the town of New Windsor, county of
Orange for the purpose of providing instruction to students enrolled  in
the school district.
  S  2.  Chapter  118  of the laws of 1969, relating to a separate union
free school district in the town of Greenburgh, in the county  of  West-
chester, is amended by adding a new section 2-c to read as follows:
  S 2-C.  NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION
TO THE CONTRARY, SUBJECT TO THE APPROVAL OF THE NEW YORK STATE EDUCATION
DEPARTMENT,  THE BOARD OF EDUCATION SHALL BE AUTHORIZED TO LEASE PROPER-
TIES LOCATED AT 45 EAST GAINSBORG AVENUE IN THE VILLAGE OF  WEST  HARRI-
SON,  COUNTY  OF  WESTCHESTER  AND  100 NORTH BROADWAY IN THE VILLAGE OF
IRVINGTON, WESTCHESTER COUNTY AND TO ENTER INTO ANY AGREEMENTS NECESSARY
TO CARRY OUT SUCH AUTHORITY, FOR THE PURPOSE OF PROVIDING INSTRUCTION TO

STUDENTS ENROLLED IN THE  GREENBURGH  NORTH  CASTLE  UNION  FREE  SCHOOL
DISTRICT.
  S  3.  The  actions  of the board of education of the Greenburgh North
Castle union free school district in entering into a lease of properties
located at 45 East Gainsborg Avenue in the  village  of  West  Harrison,
county  of Westchester, and 100 North Broadway in the village of Irving-
ton, Westchester County prior to the effective  date  of  this  act  are
hereby  ratified,  validated  and confirmed notwithstanding its location
outside of the school district boundaries.
  S 4. (a) Notwithstanding any provision of law  to  the  contrary,  the
board  of  education  of  the  Greenburgh North Castle union free school
district number twelve, created pursuant to chapter 118 of the  laws  of
1969,  as  amended,  shall be authorized to purchase property located at
the site of the Jennie Clarkson Campus (1700 Old Orchard Street, Valhal-
la, New York 10595) in the County of Westchester from St.  Christopher's
Inc.
  (b) Notwithstanding any provision of law to the contrary, the dormito-
ry  authority,  St.  Christopher's  Inc. and the Greenburgh North Castle
union free school district number twelve, of the towns of Greenburgh and
North Castle, in the county of Westchester, are each  hereby  authorized
to  enter  into such agreements as the dormitory authority deems reason-
able or necessary to comply with the requirements of subdivision (a)  of
this  section  and  to provide for the performance of the obligations of
St. Christopher's Inc. and the Greenburgh North Castle union free school
district number twelve, in accordance with the provisions of title 4  of
article 8 of the public authorities law.
  (c)  Nothing  in  this  chapter  shall  authorize the Greenburgh North
Castle union free school district number twelve, of the towns of  Green-
burgh and North Castle, and St. Christopher's Inc. from effectuating the
transactions  authorized  under  this  act  without  first obtaining any
governmental approvals, consents, licenses,  permits  and  accreditation
otherwise  required under law, which shall include but not be limited to
programmatic approval of the commissioner of education.
  S 5. This act shall take effect immediately.

TITLE OF BILL:  An act to amend chapter 118 of the laws of 1969,
relating to a separate union free school district in the town of
Greenburgh, in the county of Westchester, in relation to clarifying
the authority of the Greenburgh North Castle Union Free School
District to lease certain properties and to expand its boundaries

PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to
authorize the Greenburgh North Castle union free school district to
lease properties and expand its boundaries for the purpose of
providing instruction to students in the Greenburgh North Castle union
free school district.

SUMMARY OF SPECIFIC PROVISIONS:

Section 2-a authorizes the lease and expansion of boundaries of
properties located at 108 Shonnard Place in the city of Yonkers,
county of Westchester, and at 1700 Old Orchard Place in the village of
Valhalla, county of Westchester for the purpose of providing
instruction to students enrolled in the school district.

Section 2-b authorizes the lease and expansion of boundaries of
properties located at 623 Blooming Grove Turnpike, in the town of New
Windsor, county of Orange, to be known as the Kaplan Center Academy
for the purpose of providing instruction to students enrolled in the

school district.

Section 2-c of the bill authorizes the Greenburgh North Castle union
free school district, subject to approval of the New York State
education department, to lease properties and expand boundaries of
properties located at 45 East Gainsborg Avenue in the village of West
Harrison, county of Westchester to be known as the REACH Academy and
to enter into any agreements necessary for the purpose of providing
instruction to students enrolled in the Greenburgh North Castle union
free school district.

Section 2-d authorizes the lease and expansion of boundaries of
properties located at 100 North Broadway in the village of Irvington,
county of Westchester to be known as the Greenburgh Academy and to
enter into any agreements necessary to lease the properties for the
purpose of educating the students enrolled in the Greenburgh North
Castle union free school district.

JUSTIFICATION: This legislation is necessary to allow the Greenburgh
North Castle Union Free School District to lease properties and expand
their school boundaries.

board of education shall be authorized to lease, AND EXPAND THE  BOUNDA-
RIES OF THE SCHOOL DISTRICT FOR THE DURATION OF THE APPLICABLE LEASES TO
INCLUDE,  properties  located at 108 Shonnard Place in the city of Yonk-
ers, county of Westchester, and at 1700 Old Orchard Place in the village
of Valhalla, county of Westchester for the purpose of providing instruc-
tion to students enrolled in the school district.
