AN ACT to amend the  social  services  law,  in  relation  to  providing
  managed  care  enrollees  access to the services of the foot center of
  New York

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Paragraphs  (d),  (e),  (j)  and  (k) of subdivision 1 of
section 364-j of the social services law, paragraph (d)  as  amended  by
chapter  653  of  the  laws  of  1997 and paragraphs (e), (j) and (k) as
amended by chapter 649 of the laws of  1996,  are  amended  to  read  as
follows:
  (d) "Medical services provider". A physician, nurse, nurse practition-
er,  physician assistant, licensed midwife, dentist, optometrist, DOCTOR
OF PODIATRIC MEDICINE or other licensed health care practitioner author-
ized to provide medical assistance services.
  (e) "Center of excellence." [A] THE FOOT CENTER OF NEW  YORK  AND  ANY
health  care facility certified to operate under article twenty-eight of
the public health law that offers specialized treatment expertise in HIV
care services as defined by the commissioner of health.
  (j) "Specialty care center". A "specialty care center" shall mean  THE
FOOT  CENTER  OF    NEW  YORK AND only such centers as are accredited or
designated by an agency of the state  or  federal  government  or  by  a
voluntary  national  health  organization as having special expertise in
treating the disease or condition for which it is accredited  or  desig-
nated.
  (k) "Special care". Care, services and supplies relating to the treat-
ment  of mental illness, mental retardation, developmental disabilities,
DIABETES,  alcoholism,  alcohol  abuse  or  substance  abuse,   or   HIV
infection/AIDS.

AN ACT to amend the  social  services  law,  in  relation  to  providing

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraphs (d) and (k) of subdivision 1 of section 364-j of

  (F) THE SERVICES ARE PROVIDED BY THE FOOT CENTER OF  NEW  YORK.    THE
FOOT CENTER OF NEW YORK SHALL PRIOR TO JUNE FIRST OF EACH YEAR REPORT TO
THE  GOVERNOR,  TEMPORARY  PRESIDENT  OF  THE  SENATE AND SPEAKER OF THE
ASSEMBLY ON THE FOLLOWING: THE TOTAL NUMBER OF VISITS  MADE  BY  MEDICAL

  (F) THE SERVICES ARE PODIATRIC SERVICES AND ARE PROVIDED BY A DIAGNOS-
TIC  AND TREATMENT CENTER LICENSED BY ARTICLE TWENTY-EIGHT OF THE PUBLIC
HEALTH LAW WHICH IS AFFILIATED WITH AN  ACADEMIC  PODIATRIC  CENTER  AND
WHICH  HAS  BEEN  GRANTED  AN  OPERATING CERTIFICATE PURSUANT TO ARTICLE
TWENTY-EIGHT  OF  THE  PUBLIC  HEALTH  LAW  TO  PROVIDE  SUCH  PODIATRIC
SERVICES.  ANY  DIAGNOSTIC  AND  TREATMENT  CENTER  PROVIDING  PODIATRIC
SERVICES PURSUANT TO THIS CLAUSE SHALL PRIOR TO JUNE FIRST OF EACH  YEAR
REPORT TO THE GOVERNOR, TEMPORARY PRESIDENT OF THE SENATE AND SPEAKER OF
THE  ASSEMBLY  ON  THE  FOLLOWING:  THE  TOTAL  NUMBER OF VISITS MADE BY
MEDICAL ASSISTANCE RECIPIENTS DURING THE IMMEDIATELY PRECEDING  CALENDAR
YEAR;  THE NUMBER OF VISITS MADE BY MEDICAL ASSISTANCE RECIPIENTS DURING
THE IMMEDIATELY PRECEDING CALENDAR YEAR BY RECIPIENTS WHO WERE  ENROLLED
IN  MANAGED  CARE PROGRAMS; THE NUMBER OF VISITS MADE BY MEDICAL ASSIST-
ANCE RECIPIENTS DURING THE IMMEDIATELY PRECEDING CALENDAR YEAR BY RECIP-
