AN ACT to amend the mental hygiene law, in relation to the definition of
  autism

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 1.03 of the mental hygiene law is amended by adding
a new subdivision 59 to read as follows:
  59.  "AUTISM"  MEANS A PERVASIVE DEVELOPMENTAL DISORDER THAT MEETS ANY
OF THE FOLLOWING CRITERIA:
  (A) AUTISTIC DISORDER, WHICH IS:
  (I) THE DIAGNOSES OF AT LEAST SIX OF THE FOLLOWING SYMPTOMS,  WITH  AT
LEAST  TWO  SYMPTOMS  COMING  FROM  CLAUSE ONE OF THIS SUBPARAGRAPH, ONE
SYMPTOM COMING FROM CLAUSE TWO OF THIS  SUBPARAGRAPH,  AND  ONE  SYMPTOM
COMING FROM CLAUSE THREE OF THIS SUBPARAGRAPH.
  (1)  QUALITATIVE IMPAIRMENT IN SOCIAL INTERACTION, AS MANIFESTED BY AT
LEAST TWO OF THE FOLLOWING:
  (A) MARKED IMPAIRMENT IN THE USE OF MULTIPLE, NONVERBAL BEHAVIORS SUCH
AS EYE-TO-EYE GAZE, FACIAL EXPRESSION, BODY POSTURES, AND  GESTURES,  TO
REGULATE SOCIAL INTERACTION.
  (B) FAILURE TO DEVELOP PEER RELATIONSHIPS APPROPRIATE TO DEVELOPMENTAL
LEVEL.
  (C)  A  LACK  OF SPONTANEOUS SEEKING TO SHARE ENJOYMENT, INTERESTS, OR
ACHIEVEMENTS WITH OTHER PEOPLE (E.G., BY A LACK OF SHOWING, BRINGING, OR
POINTING OUT OBJECTS OF INTEREST).
  (D) LACK OF SOCIAL OR EMOTIONAL RECIPROCITY.
  (2) QUALITATIVE IMPAIRMENTS IN COMMUNICATION AS MANIFESTED BY AT LEAST
ONE OF THE FOLLOWING:
  (A) DELAY IN, OR TOTAL LACK OF, THE  DEVELOPMENT  OF  SPOKEN  LANGUAGE
(NOT  ACCOMPANIED  BY AN ATTEMPT TO COMPENSATE THROUGH ALTERNATIVE MODES
OF COMMUNICATION SUCH AS GESTURE OR MIME).
  (B) IN INDIVIDUALS WITH ADEQUATE  SPEECH,  MARKED  IMPAIRMENT  IN  THE
ABILITY TO INITIATE OR SUSTAIN A CONVERSATION WITH OTHERS.

AN ACT to define the term "autism" for the purposes of the education law
  and the mental hygiene law and the term "autism spectrum disorder" for
  the purposes of the insurance law and providing for the repeal of such
  provisions upon expiration thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Legislative Intent.  The  legislature  hereby  finds  that,
according  to Centers for Disease Control and Prevention, as many as one
in 50 children may have an autism spectrum disorder (ASD). The  legisla-
ture  further  finds  that  early,  continuous and appropriate treatment
facilitates the best possible outcome for children diagnosed with  ASDs.
The  legislature further finds that, while the periodic reformulation of
diagnostic criteria is vital to  ensuring  the  provision  of  effective
care,  the State must respond accordingly to guarantee that such changes
