BRINDISI -- read once and referred to the Commit- tee on Housing AN ACT to amend the private housing finance law, in relation to enacting the "affordable housing act" relating to the utilization of manufac- tured housing as affordable housing for persons of lower, moderate or fixed incomes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The private housing finance law is amended by adding a new article 24-A to read as follows: ARTICLE XXIV-A AFFORDABLE HOUSING ACT SECTION 1175. SHORT TITLE. 1176. STATEMENT OF LEGISLATIVE FINDINGS AND PURPOSES. 1177. DEFINITIONS. 1178. GENERAL PROVISIONS. S 1175. SHORT TITLE. THIS ARTICLE SHALL BE KNOWN AND MAY BE CITED AS THE "AFFORDABLE HOUSING ACT". S 1176. STATEMENT OF LEGISLATIVE FINDINGS AND PURPOSES. THE LEGISLA- TURE FINDS AND DECLARES THAT A NEED FOR AFFORDABLE HOUSING EXISTS FOR RESIDENTS AND THAT THE STATE'S RESIDENTS HAVE A RIGHT TO AFFORDABLE HOUSING. THE LEGISLATURE HAS DETERMINED THAT MANUFACTURED HOUSING PROVIDES STATE HOMEOWNERS WITH AN AFFORDABLE SOURCE OF DECENT, SAFE AND SANITARY HOUSING ON A PERMANENT BASIS. THE LEGISLATURE FURTHER FINDS THAT THE IMPROVED DESIGN, APPEARANCE AND SIGNIFICANT TECHNOLOGICAL ADVANCES OF MANUFACTURED HOUSING BUILT TO HOUSING AND URBAN DEVELOPMENT CODE STANDARDS, MAKES MANUFACTURED HOUSING EQUIVALENT TO CONVENTIONAL, SITE-BUILT SINGLE FAMILY DWELLINGS FOR PURPOSES OF LAND-USE CONTROLS AND HOUSING CODE STANDARDS. THEREFORE, THE LEGISLATURE FINDS AND DECLARES THAT IT IS IN THE PUBLIC INTEREST FOR THE STATE OF NEW YORK TO PROMOTE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. BRINDISI -- read once and referred to the Commit- tee on Housing -- recommitted to the Committee on Housing in accord- ance with Assembly Rule 3, sec. 2 -- reported from committee, advanced to a third reading, amended and ordered reprinted, retaining its place on the order of third reading AN ACT to amend the executive law, in relation to single-family dwell- ings of manufactured homes in residential districts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Sections 600 through 612 of article 21-B of the executive law are designated title 1 and a new title heading is added to read as follows: GENERAL PROVISIONS S 2. Section 600 of the executive law, as added by chapter 729 of the laws of 2005, is amended to read as follows: S 600. Application. This [article] TITLE shall be applicable to persons and business entities engaged in the manufacture, sale, instal- lation and service of manufactured homes and to purchasers thereof. S 3. The opening paragraph of section 601 of the executive law, as added by chapter 729 of the laws of 2005, is amended to read as follows: For the purposes of this [article] TITLE, the following terms shall have the following meanings: S 4. Article 21-B of the executive law is amended by adding a new title 2 to read as follows: TITLE 2 SINGLE-FAMILY DWELLINGS IN RESIDENTIAL DISTRICTS SECTION 615. DEFINITIONS. 616. MANUFACTURED HOMES AS SINGLE-FAMILY DWELLINGS IN RESIDEN- TIAL DISTRICTS. 617. MANUFACTURED HOME PARKS TO BE CONSISTENT.
