AN ACT relating to creating a green energy emergency backup program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. 1. Notwithstanding any other  provision  of  law,  rule  or
regulation  to  the  contrary,  a  Green Energy Emergency Backup Program
shall be created and administered by the New York state energy  research
and development authority.
  2.  The  New York state energy research and development authority will
promulgate rules and guidelines for a program aimed at providing assist-
ance to owners of retail motor fuel stations that seek to install renew-
able energy backup systems powered by renewable energy sources,  includ-
ing but not limited to solar and wind power. Funds provided through this
program  shall  also  allow  for assistance in installing battery backup
technology or other energy storage devices.
  3. The authority shall conduct competitive solicitations for proposals
and establish clear criteria for awards. Such competitive  solicitations
shall be designed in a manner and form to be determined by the authority
as  well  as  a  schedule  for  such  competitive  solicitations,  award
selection and distribution of funds. The authority shall rank  proposals
received in response to competitive solicitations and choose the highest
ranked proposals measured on the criteria established. No single recipi-
ent shall receive a grant exceeding fifty percent of the total installed
cost of the project.
  4.  The  authority shall make available $25 million from federal funds
allocated to the state of New  York  for  hurricane  relief  which  were
appropriated in January of 2013, that are not already directly earmarked
for  another clearly delineated statutory purpose, for the establishment
of this grant program.
  S 2. This act shall take effect immediately.
