BILL NUMBER:S4180 TITLE OF BILL: An act to amend the education law, in relation to requiring colleges to notify students whether dormitories are equipped with sprinkler systems PURPOSE: The purpose of this bill is to require that every college or university in the state of New York notify their students, in writing, whether or, not their assigned college owned housing facility is equipped with a fire sprinkler or fire suppression system. SUMMARY OF PROVISIONS: The education law is to be amended by adding a new section 6438. JUSTIFICATION: Kerry Rose Fitzsimons, a student at Marist College, died in a fire in her off-campus housing unit in January 2012 along with two other students. The unit was not equipped with a fire sprinkler system. Her family and friends started the Kerry Rose Foundation in her memory to warn and educate all college students and their families about the importance of knowing whether or not their assigned college housing is equipped with a fire sprinkler or other fire suppression system. Most students and parents believe that all college owned on-campus or off-campus living spaces are fitted with this lifesaving fire protection equipment. Studies have indicated that as much as 50% of college owned housing is not properly equipped with fire sprinkler systems. Another disturbing fact is that housing is

The education law is amended by adding a new section 6438 to read as follows: S 6438. NOTIFICATION OF SPRINKLER SYSTEMS IN DORMITORIES. EACH COLLEGE SHALL NOTIFY EACH INCOMING STUDENT WHO WILL BE RESIDING IN A DORMITORY UNDER THE JURISDICTION OF THE COLLEGE WHETHER THE DORMITORY IS EQUIPPED WITH A SPRINKLER SYSTEM. FOR THE PURPOSES OF THIS SECTION, "SPRINKLER SYSTEM" SHALL HAVE THE SAME MEANING AS IN SECTION ONE HUNDRED FIFTY-FIVE-A OF THE EXECUTIVE LAW. S 2. This act shall take effect immediately. EACH COLLEGE SHALL PROVIDE WRITTEN NOTIFICATION TO STUDENTS RESIDING IN COLLEGE-OWNED OR COLLEGE-OPERATED HOUSING WITH REGARD TO A DESCRIPTION OF SUCH HOUSING FACILITY'S FIRE SAFETY SYSTEM, INCLUDING WHETHER THE HOUSING IS OR IS NOT EQUIPPED WITH A SPRINKLER SYSTEM. EACH COLLEGE SHALL ALSO INDICATE, WITHIN SUCH WRITTEN NOTIFICATION, HOW TO ACCESS THE CAMPUS FIRE SAFETY REPORT ON STUDENT HOUSING AS REQUIRED UNDER TITLE 20 OF THE U.S. CODE SECTION 1092(I). FOR THE PURPOSES OF THIS SECTION, "SPRINKLER SYSTEM" SHALL HAVE THE SAME MEANING AS IN SECTION ONE HUNDRED FIFTY-FIVE-A OF THE EXECUTIVE LAW. S 2. This act shall take effect immediately.
