BILL NUMBER:S4985 TITLE OF BILL: An act to amend the criminal procedure law, in relation to peace officers PURPOSE: To promote school safety by providing retired police officers with peace officer status when they are employed by a school district as a school resource officer. SUMMARY OF PROVISIONS: Section 1. Amends section 2.10 of the criminal procedure law by expanding the definition of peace officer to include retired police officers employed by a school district as a school resource officer. Section 2. This act shall take effect immediately JUSTIFICATION: School resource officers are great assets to school districts striving to enhance school safety. School resource officers are not just hired guards; they collaborate with educators, parents, and children to develop educational programs, prevent drug abuse, and minimize violence. GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to peace offi- cers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 84 to read as follows: 84. RETIRED POLICE OFFICERS EMPLOYED BY A SCHOOL DISTRICT AS A SCHOOL RESOURCE OFFICER; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW.
