BILL NUMBER:S5110

TITLE OF BILL:  An act to amend the public service law, in relation to
electric car charging stations

PURPOSE:

To ensure that electric car charging stations are not subject to
regulation as an electric corporation by the Public Service Commission

SUMMARY OF PROVISIONS:

Section 1: Amends section 5 of the public service law to clarify that
a person or corporation who owns, leases or operates an electric car
charging station is not subject to the regulations of this section,
that are typically applied to electric utility corporations.

Section 2: Sets forth the effective date

JUSTIFICATION:

Recently the Legislature approved the Charge NY program as a part of
the 2013-2014 budgets. This program will lead to the installation of
360 electric vehicle and plug-in hybrid charging stations across New
York State. The State's goal is to create a statewide network of up to
3,000 stations over the next several years in order to put 40,000

plug-in vehicles on the road. This program is aimed at jump starting a
new, cutting edge industry in New York State, and also reaping the
environmental benefits inherent in using plug-in electric vehicles.

The purpose of this bill is to ensure that companies who want to
partner with the state in constructing, maintaining and operating
electric vehicle charging stations can implement their innovative
technologies with a sense of regulatory surety. In 2010-2011,
controversy erupted in California when the State's Public Utility
Commission, considered regulating charging stations under its
authority aimed at oversight of electric utility corporations.
Eventually, the Commission relented, but because this decision was not
made in statute but instead by the regulatory body, therefore is
always a chance that the regulation could be changed. In order to
provide clear regulatory certainty to a nascent industry and encourage
its development in New York, this bill seeks to put into statute a
clear directive from the legislature that electric car charging
stations shall not be subject to PSC jurisdiction as electric utility
corporations

AN  ACT  to  amend  the  public service law, in relation to electric car
  charging stations

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 5 of the public service law is amended by adding a
new subdivision 7 to read as follows:
  7. A PERSON OR CORPORATION OWNING, LEASING  OR  OPERATING  A  FACILITY
THAT SUPPLIES ELECTRICITY TO THE PUBLIC FOR THE SOLE PURPOSE OF CHARGING
PLUG-IN ELECTRIC VEHICLES IS NOT SUBJECT TO THE PROVISIONS OF THIS CHAP-
TER  AS  AN ELECTRIC CORPORATION SOLELY BECAUSE OF SUCH OWNERSHIP, LEASE
OR OPERATION.
  S 2. This act shall take effect immediately.
