BILL NUMBER:S5352 TITLE OF BILL: An act to authorize the town of Bedford in Westchester county to apply revenue received from any one municipally-owned town cemetery to help defray the costs of improvements made to any other municipally-owned town cemetery PURPOSE: This bill authorizes the town of Bedford in Westchester county to apply revenue received from any one municipally-owned town cemetery to another municipally-owned town cemetery. SUMMARY OF PROVISIONS: Section 1. Notwithstanding article 15 of the not-for-profit corporation law or any other law to the contrary, the town of Bedford in the county of Westchester is hereby authorized to apply any revenue received from any one cemetery owned by the town of Bedford to help defray the cost of improvements made to any other public cemetery owned by the town of Bedford, JUSTIFICATION: Cemeteries around the state are finding themselves in disrepair with no funding to address this issue. Cemeteries serve a very important (although seldom thought of) function in our society. They help to preserve the history of many communities throughout our state and around our great country. Some are large like Arlington National Cemetery and some are much smaller like Bedford Cemetery. Big or small they are all important and play a part in everyone's life. They are a place of solace. They are a place of remembrance.

Notwithstanding article 15 of the not-for-profit corpo- ration law or any other law to the contrary, the town of Bedford in the county of Westchester is hereby authorized to apply any revenue received from any one cemetery owned by the town of Bedford to help defray the costs of improvements made to any other public cemetery owned by the town of Bedford. SUMMARY OF PROVISIONS: Section 1 authorizes the town of Bedford in the County of Westchester to apply any revenue received from Chichester cemetery owned by the town to help defray the cost of improvements made to any other public cemetery owned by the town of Bedford. Section 2 legalizes, validates, ratifies and confirms the previous transfer of funds made by the Bedford town board from Chichester Cemetery to other Bedford owned cemeteries. Section 3 sets the effective date.

Notwithstanding section 290 of the town law, the town of Bedford, in the county of Westchester, is hereby authorized to transfer funds received from the sale of burial plots in the Chichester Cemetery to any other municipally owned cemetery in the town for general mainte- nance and improvement to such cemeteries. Nothing in this act shall relieve the town of Bedford of its obligation to maintain the Chichester Cemetery. S 2. Notwithstanding section 290 of the town law, all proceedings and actions taken by the town board of the town of Bedford, in the county of Westchester, in relation to the transfer of $12,975 from the Chichester Cemetery fund to repair head stones in the Lake Marie, Buxton, Old Bury- ing Ground and Chichester Cemeteries, are hereby legalized, validated, ratified and confirmed.
