BILL NUMBER:S5408 TITLE OF BILL: An act to amend the executive law, in relation to adding the Wappinger Creek to the definition of inland waterways PURPOSE: This legislation will include the Wappinger Creek as one of New York State's major creeks, and for it to be considered an inland waterway SUMMARY OF PROVISIONS: Section 1 amends paragraph (c) of subdivision 4 of section 911 of the executive law to include Wappinger Creek among the state's major creeks. Section 2 establishes an effective date JUSTIFICATION: Wappinger Creek plays an important role in Dutchess County, as it is the basis for the county's largest watershed. It is home to a number of resident and migratory species, and is a vital component of the Dutchess county ecosystem. A healthy creek is important for groundwater quality, biodiversity,

GIPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to adding the Wappinger Creek to the definition of inland waterways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 4 of section 911 of the execu- tive law, as amended by chapter 133 of the laws of 2012, is amended to read as follows: (c) the state's major creeks comprised of the Bushkill, Cattaraugus, Cincinnati, East Kill, Esopus (including upper and lower branches), Fish (including east and west branches), Gooseberry, Little Sandy, Onondaga, Sandy, Schoharie, South Sandy, Oatka [and], Tonawanda [and], West Kill, AND WAPPINGER; S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11006-01-3
