BILL NUMBER:S5685 TITLE OF BILL: An act to authorize the town board of the town of Marbletown to hold meetings in the town of Rosendale and the town justice court of the town of Marbletown and the town justice court of the town of Rochester to hold justice court in the town of Rosendale PURPOSE OR GENERAL IDEA OF BILL: This legislation allows the town of Marbletown and the town of Rochester to move select town services to the currently vacant Rosendale Elementary School in the town of Rosendale in order to achieve a cost savings. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Authorizes the town board of Marbletown to adopt a resolution to establish a town hall in the town of Rosendale. Authorizes the town board of Marbletown to adopt a resolution to allow any justice of the town of Marbletown to hold court proceedings in the town of Rosendale should the town board of Rosendale authorize this. Section 2: Authorizes the town board of the town of Rochester to adopt a resolution to allow any justice of the town of Rochester to hold court proceedings in the town of Rosendale should the town board of Rosendale authorize this. TKACZYK -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize the town board of the town of Marbletown to hold meetings in the town of Rosendale and the town justice court of the town of Marbletown and the town justice court of the town of Rochester to hold justice court in the town of Rosendale THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary: (a) the town board of Marbletown is hereby authorized, upon the adoption of a resolution, to establish and maintain in the town of Rosendale an office or offices for the conduct of the town's business and the town board, town supervisor, town clerk, town superintendent of highways, town assessor, the planning board, the zoning board of appeals, building safety and code enforcement department, and any other town officer, official board, commission, committee, or agency of the town of Marble- town are hereby authorized and empowered to hold meetings and hearings and to perform their official acts and functions for such town in the town of Rosendale; (b) whenever any provision of law permits or requires the filing of any instrument, document, map, or other paper in a town, the filing thereof in the office of the town clerk of Marbletown shall be deemed to be filing in the town of Marbletown; and (c) any justice of the town of Marbletown may hold all court proceedings and perform any function or official act within his or her jurisdiction in the town of Rosendale provided that such proceedings are held in a courtroom or other suitable facility open to the public, and provided further that the town boards of Marbletown and Rosendale have authorized such extra- territorial proceedings. S 2. Notwithstanding any provision of law to the contrary, any justice of the town of Rochester may hold all court proceedings and perform any function or official act within his or her jurisdiction in the town of EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
