S T A T E O F N E W Y O R K ________________________________________________________________________ 1509 2015-2016 Regular Sessions I N A S S E M B L Y January 12, 2015 ___________ Introduced by M. of A. CAHILL -- read once and referred to the Committee on Energy AN ACT to amend the public service law, in relation to electric trans- mission lines and existing or proposed generating resources THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (d) of subdivision 1 and subdivision 2 of section 126 of the public service law, paragraph (d) of subdivision 1 as added by chapter 272 of the laws of 1970, subdivision 2 as added by chapter 520 of the laws of 1984, are amended to read as follows: (d) in the case of an electric transmission line, (1) what part, if any, of the line shall be located underground; (2) that such facility conforms to a long-range plan for THE expansion, MAINTENANCE AND IMPROVEMENT of the electric power grid of the electric systems serving [this] NEW YORK state and interconnected utility systems, which will serve the interests of electric system economy and reliability; (3) THAT SUCH FACILITY WILL ACCOMMODATE THE INTERCONNECTION OF EXISTING OR PROPOSED GENERATING RESOURCES OR IN THE CASE OF A FACILITY THAT AS PROPOSED, HAS A DESIGN CAPACITY OF LESS THAN ONE HUNDRED KILOVOLTS, THAT NO ACCOMMODATION IS NECESSARY BECAUSE SUCH ACCOMMODATION WOULD NOT BE IN THE INTERESTS OF ELECTRIC SYSTEM ECONOMY AND RELIABILITY; AND (4) IN THE CASE OF A FACILITY, THAT AS PROPOSED, WOULD TRANSMIT ELECTRICITY GENER- ATED FROM RESOURCES LOCATED OUTSIDE OF THE BOUNDARIES OF NEW YORK STATE, THAT SUCH ELECTRICITY WOULD BE PRODUCED IN A MANNER THAT IS CONSISTENT WITH THE POWER PLANT EMISSIONS AND PERFORMANCE STANDARDS ESTABLISHED PURSUANT TO SECTION 19-0312 OF THE ENVIRONMENTAL CONSERVATION LAW; 2. In the case of an electric transmission line to be constructed by the power authority of the state of New York and located in part under the waters of Long Island Sound and for the remaining part underground, the commission shall make only the findings and determinations required by paragraphs (b), (c), (D) and (f) of subdivision one of this section and, on the basis of such findings and determinations, shall grant, grant in part, or deny the certificate. S 2. This act shall take effect immediately.
