AN ACT to amend the executive law, in relation to the definition of  sky
  lantern and the requirement to have sky lanterns anchored and tethered

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 372 of the executive law is amended by adding a new
subdivision 20 to read as follows:
  20. "SKY LANTERN" MEANS AN AIRBORNE  PAPER  LANTERN  CONSTRUCTED  FROM
OILED  RICE PAPER ON A WIRE OR BAMBOO FRAME THAT CONTAINS A SMALL CANDLE
OR FUEL CELL COMPOSED OF A WAXY FLAMMABLE MATERIAL.
  S 2. Section 378 of the executive law  is  amended  by  adding  a  new
subdivision 17 to read as follows:
  17.  STANDARDS FOR SKY LANTERNS, AS DEFINED IN THIS ARTICLE, REQUIRING
THAT SKY LANTERNS BE ANCHORED AND TETHERED.
  S 3. This act shall take effect on the ninetieth day  after  it  shall
have become a law.
