AN ACT to amend the penal law, in relation to sentencing

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 3 of section 70.08 of the penal law, as amended
by  section 7 of chapter 107 of the laws of 2006, is amended by adding a
new paragraph (d) to read as follows:
  (D) FOR A CLASS E FELONY THE MINIMUM PERIOD MUST  BE  AT  LEAST  THREE
YEARS AND MUST NOT EXCEED TWENTY-FIVE YEARS.
  S  2.  Subdivision  3 of section 70.08 of the penal law, as amended by
section 8 of chapter 107 of the laws of 2006, is amended by adding a new
paragraph (d) to read as follows:
  (D) FOR A CLASS E FELONY THE MINIMUM PERIOD MUST  BE  AT  LEAST  THREE
YEARS AND MUST NOT EXCEED TWENTY-FIVE YEARS.
  S  3.  This  act shall take effect immediately; provided, however that
this act shall apply to offenses committed on or  after  such  effective
date;  and  provided  further  that  the  amendments to subdivision 3 of
section 70.08 of the penal law made by section one of this act shall  be
subject  to the expiration and reversion of such subdivision pursuant to
subdivision d of section 74 of  chapter  3  of  the  laws  of  1995,  as
amended,  when  upon such date the provisions of section two of this act
shall take effect.
