AN ACT to amend the vehicle and traffic law, in relation  to  electronic
  toll collections

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The vehicle and traffic law is  amended  by  adding  a  new
section 391-a to read as follows:
  S  391-A.  ELECTRONIC TOLL COLLECTIONS. NOTWITHSTANDING THE PROVISIONS
OF ANY LAW TO THE CONTRARY, ANY TOLL PLAZA, BOOTH OR BARRIER LOCATED  IN
THE  COUNTY  OF  ORANGE, ROCKLAND, WESTCHESTER, BRONX, NEW YORK, QUEENS,
KINGS, RICHMOND, NASSAU OR SUFFOLK, OPERATING UNDER THE NEW  YORK  STATE
THRUWAY  AUTHORITY,  THE  METROPOLITAN  TRANSPORTATION  AUTHORITY OR THE
TRIBOROUGH BRIDGE AND TUNNEL AUTHORITY, SHALL ONLY OFFER  AN  ELECTRONIC
METHOD  OF  PAYMENT FOR ANY TOLLS, FARES, FEES, OR OTHER CHARGES ASSOCI-
ATED WITH TRAVEL ON SUCH ROADS, HIGHWAYS, TUNNELS OR BRIDGES. THE CHAIR-
PERSON OF  EACH  AUTHORITY  SHALL  ESTABLISH,  BY  RULE  OR  REGULATION,
REQUIREMENTS  FOR  THE  PLACEMENT  OF  SUCH  ELECTRONIC  TOLL COLLECTION
SYSTEMS. SUCH ELECTRONIC TOLL COLLECTION SYSTEM SHALL INCLUDE BUT NOT BE
LIMITED TO THE E-ZPASS SYSTEM AND A SYSTEM USED TO CAPTURE  THE  LICENSE
PLATE  OF  EVERY  VEHICLE DRIVEN BY A NON-ELECTRONIC PASS HOLDER. AT THE
CONCLUSION OF EACH MONTH, THE NEW  YORK  STATE  THRUWAY  AUTHORITY,  THE
METROPOLITAN  TRANSPORTATION  AUTHORITY  AND  THE  TRIBOROUGH BRIDGE AND
TUNNEL AUTHORITY SHALL COMPILE THE DATA CAPTURED BY SUCH SYSTEM  OF  ALL
NON-ELECTRONIC  PASS  HOLDERS AND PRODUCE A MONTHLY TOLL STATEMENT TO BE
MAILED TO EACH NON-ELECTRONIC PASS HOLDER. ADDITIONAL INFORMATION  GATH-
ERED  FROM THE DEPARTMENT SHALL BE USED TO PRODUCE AND POST SUCH MONTHLY
STATEMENTS.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law, provided, however, that the chairpersons  of
the  New  York  state thruway authority, the metropolitan transportation
authority and the Triborough bridge and tunnel authority are  authorized
and  directed to promulgate any rules or regulations necessary to imple-
ment the provisions of this act on or before such effective date.
