AN ACT to amend the education law, in relation to the provision of human
  sexual education in elementary schools

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. The education law is amended by adding a new section 804-e
to read as follows:
  S 804-E. INSTRUCTION IN HUMAN SEXUALITY; ELEMENTARY SCHOOLS. NO  PUPIL
IN  GRADES KINDERGARTEN THROUGH EIGHT SHALL RECEIVE INSTRUCTION IN HUMAN
SEXUALITY UNLESS THE PERSON IN  PARENTAL  RELATION  TO  SUCH  PUPIL  HAS
CONSENTED  TO  THE PROVISION OF SUCH INSTRUCTION TO HIS OR HER CHILD. NO
LESS THAN FIFTEEN DAYS PRIOR TO THE SCHEDULED PROVISION  OF  INSTRUCTION
IN HUMAN SEXUALITY TO A PUPIL IN GRADES KINDERGARTEN THROUGH EIGHT, EACH
SCHOOL SHALL CAUSE TO BE DELIVERED TO THE PERSON IN PARENTAL RELATION TO
SUCH  PUPIL A CONSENT FORM WHICH OUTLINES THE SPECIFIC SUBJECT MATTER TO
BE PROVIDED IN SUCH INSTRUCTION AND WHICH PROVIDES SPACE FOR SUCH PERSON
TO ELECT TO AUTHORIZE THE PROVISION OF THE INSTRUCTION IN HUMAN SEXUALI-
TY. ONLY THOSE PUPILS WHOSE PERSONS IN PARENTAL RELATION HAVE  CONSENTED
TO  THE PROVISION OF SUCH INSTRUCTION SHALL BE PROVIDED WITH INSTRUCTION
IN HUMAN SEXUALITY.
  S 2. This act  shall  take  effect  immediately  and  shall  apply  to
instruction provided on or after such date.
