BILL NUMBER:S4544 TITLE OF BILL: An act to amend the public health law, in relation to including certain doses of pseudoephedrine as a controlled substance PURPOSE: This bill makes 120 milligrams or more of pseudoephedrine a schedule II controlled substance. SUMMARY OF PROVISIONS: Section 1 amends § 3306 of the public health law by adding a new paragraph providing 120 milligrams or more of pseudoephedrine as a schedule II controlled substance. Section 2 provides the effective date. JUSTIFICATION: Methamphetamine is an extremely dangerous, highly addictive drug classified as a Schedule II stimulant. Users experience a "rush" that is believed to be a result of the release of very high levels of the neurotransmitter, dopamine. Chronic meth abusers exhibit violent

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to including certain doses of pseudoephedrine as a controlled substance THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (d) of schedule II of section 3306 of the public health law, is amended by adding a new paragraph 6 to read as follows: (6) 120 MILLIGRAMS OR MORE OF PSEUDOEPHEDRINE. S 2. This act shall take effect on the ninetieth day after it shall have become a law; provided however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date is authorized to be made and completed on or before such effective date. Section 2 provides that the addition of pseudoephedrine to the list of schedule II drugs does not apply to a wholesale drug distributor licensed and regulated by the New York Board of Pharmacy and Registered with and regulated by the United States DEA Such distributors are exempt from storage, reporting, recordkeeping, and physical security control requirements for schedule II controlled substances containing pseudoephedrine Section 3 provides the effective date. Subdivision (d) of schedule II of section 3306 of the public health law, is amended by adding a new paragraph 6 to read as follows: (6) 120 MILLIGRAMS OR MORE OF PSEUDOEPHEDRINE. S 2. The provisions of paragraph 6 of subdivision (d) of schedule II of section 3306 of the public health law shall not apply to a wholesale drug distributor licensed and regulated by the New York board of pharma- cy and registered with and regulated by the United States drug enforce- ment administration. Such distributors are exempt from storage, report- ing, recordkeeping, and physical security control requirements for schedule II controlled substances containing any material, compound, mixture, or preparation that contains any quantity of pseudoephedrine. S 3. This act shall take effect on the ninetieth day after it shall have become a law; provided however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date is authorized to be made and completed on or before such effective date.
