BILL NUMBER:S4650 TITLE OF BILL: An act to authorize the city of New York to transfer ownership of certain parklands to Alexander's of Rego Park III, Inc. PURPOSE OR GENERAL IDEA OF BILL: This bill will authorize the city of New York to exchange a light and air easement volume on city-owned parkland that is part of Lost Battalion Hall Park in the borough of Queens for a light and air easement volume equal in size, on privately owned land contiguous to the park. SPECIFIC PROVISIONS: Section 1. Authorizes the city of New York through the commissioner of parks and recreation to transfer the light and air easement volume described in section three of this act. Section 2. Relates to fair market value in relation to dedicating difference to Alexander's of Rego Park or the acquisition/improvement of additional parkland. Section 3. Delineates all boundaries of easement volume being transferred to Alexander's of Rego Park by the city.

STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to authorize the city of New York to transfer ownership of certain parklands to Alexander's of Rego Park III, Inc. THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subject to the provisions of this act, the city of New York, acting by and through the commissioner of parks and recreation of such city, is authorized to transfer the light and air easement volume described in section three of this act to Alexander's of Rego Park III, Inc. in exchange for a certain light and air easement volume, described in section four of this act, that is contiguous to Lost Battalion Hall park in the borough of Queens. Such exchange shall be made upon such terms and conditions as shall be agreed upon between the parties. S 2. In the event that the fair market value of the easement volume acquired from Alexander's of Rego Park III, Inc. is not equal to or greater than the fair market value of the easement value transferred to Alexander's of Rego Park III, Inc., the city of New York shall dedicate the difference between the fair market value of the easement volume transferred to Alexander's of Rego Park III, Inc., and the fair market value of the easement volume acquired from Alexander's of Rego Park III, Inc., for the acquisition of additional parkland and/or for capital improvements to existing park and recreational facilities within the borough of Queens. S 3. The easement volume to be transferred to Alexander's of Rego Park III, Inc. is a part of block 2076 lot 50, block 2077 lots 50, 98 and 8901 and bed of former 62nd Avenue in the borough of Queens, more particularly described as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. In the event that the fair market value of the surface easement acquired from Alexander's of Rego Park III, Inc. is not equal to or greater than the fair market value of the light and air easement trans- ferred to Alexander's of Rego Park III, Inc., the city of New York shall dedicate the difference between the fair market value of the light and air easement conveyed to Alexander's of Rego Park III, Inc., and the fair market value of the surface easement acquired from Alexander's of Rego Park III, Inc., for the acquisition of additional parkland and/or for capital improvements to existing park and recreational facilities within the borough of Queens. Subject to the provisions of this act, the city of New York, acting by and through the commissioner of parks and recreation of such city, is authorized to transfer the light and air easement volume described in section four of this act above Lost Battalion Hall Park in the borough of Queens to Alexander's of Rego Park III, Inc. in exchange for a certain light and air easement volume, described in section five of this act, that is contiguous to such park. Such exchange shall be made upon such terms and conditions as shall be agreed upon between the parties. S 2. The authorization contained in section one of this act shall only be effective on the condition that any residential or commercial devel- opment to be constructed adjacent to the Lost Battalion Hall Park contain adequate space for classrooms to be used to operate public full- day pre-kindergarten programs. Such programs shall offer, at a minimum, a total of thirty-six full day slots. Such classrooms shall serve no more than eighteen students per classroom, shall be located on the ground level of such development and shall comply with all applicable minimum square footage requirements, including those as may be required by the state education department or the department of education of the EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
