BILL NUMBER:S5064 TITLE OF BILL: An act to amend the public health law and the insurance law, in relation to requiring health insurers to accept third party payments for coverage PURPOSE: This bill amends the public health and insurance laws in relation to not allowing health insurers to refuse third party premium payments. SUMMARY OF PROVISIONS: Section 1 amends section 4406-c of the Public Health Law to ensure that health plans do not reject premium payments and any required cost-sharing from third-parties on behalf of an enrollee. Sections 2 and 3 make the same amendments to sections of the insurance law. Section 4 - Effective date. JUSTIFICATION: Individuals should not lose health care coverage as a result of a failure to pay premiums if there is a viable third party willing and

HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law and the insurance law, in relation to requiring health insurers to accept third party payments for cover- age THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 4406-c of the public health law is amended by adding a new subdivision 9 to read as follows: 9. WITH REGARD TO A SUBSCRIBER CONTRACT OFFERED THROUGH THE INDIVIDUAL MARKET, A HEALTH MAINTENANCE ORGANIZATION SHALL NOT BY CONTRACT OR IN ANY OTHER MANNER REFUSE TO ACCEPT PREMIUM OR ANY REQUIRED COST SHARING PAYMENTS FROM THIRD PARTIES. S 2. Section 3217-b of the insurance law is amended by adding a new subsection (k) to read as follows: (K) WITH REGARD TO AN INSURANCE POLICY OFFERED THROUGH THE INDIVIDUAL MARKET, AN INSURER SHALL NOT BY CONTRACT OR IN ANY OTHER MANNER REFUSE TO ACCEPT PREMIUM OR ANY REQUIRED COST SHARING PAYMENTS FROM THIRD PARTIES. S 3. Section 4325 of the insurance law is amended by adding a new subsection (l) to read as follows: (L) WITH REGARD TO AN INSURANCE CONTRACT OFFERED THROUGH THE INDIVID- UAL MARKET, A CORPORATION ORGANIZED UNDER THIS ARTICLE SHALL NOT BY CONTRACT OR IN ANY OTHER MANNER REFUSE TO ACCEPT PREMIUM OR ANY REQUIRED COST SHARING PAYMENTS FROM THIRD PARTIES. S 4. This act shall take effect immediately and shall apply to all policies and contracts issued, renewed, modified, altered or amended on or after January 1, 2016.
