BILL NUMBER:S5839 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to authorizing the state liquor authority to issue a license to sell beer at retail for consumption off-premises to a grocery store located within the town of Copake PURPOSE: This legislation would allow for an exemption under the Alcoholic Beverage Control law to authorize the Copake Front Porch Market to apply for an off-premise license from the New York State Liquor Authority. SUMMARY OF PROVISIONS: § 1- Amends subdivision 1 of S 110 of the Alcoholic Beverage Control Law by adding a new paragraph (a-1). § 2- Effective date. JUSTIFICATION: Section 110 of New York State's Alcoholic Beverage Control law provides specific requirements for how the applicant must represent their corporate structure to the State Liquor Authority. MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to authorizing the state liquor authority to issue a license to sell beer at retail for consumption off-premises to a grocery store located within the town of Copake THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 110 of the alcoholic beverage control law is amended by adding a new paragraph (a-1) to read as follows: (A-1) NOTWITHSTANDING THE PROVISIONS OF SUBPARAGRAPH (III) OF PARA- GRAPH (A) OF THIS SUBDIVISION, THE AUTHORITY MAY ISSUE A LICENSE TO SELL BEER AT RETAIL FOR CONSUMPTION OFF-PREMISES TO A GROCERY STORE LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE TOWN OF COPAKE AND THE COUNTY OF COLUMBIA BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT CERTAIN LOT, PIECE OR PARCEL OF LAND SITUATED, LYING AND BEING IN THE TOWN OF COPAKE, COUNTY OF COLUMBIA AND STATE OF NEW YORK, AND BEING MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A RECOVERED IRON ROD ON THE NORTHERLY LINE OF A PUBLIC ROAD KNOWN AS COUNTY ROUTE 7A, SAID POINT ALSO BEING AT THE NORTHEAST CORNER OF THE HEREIN DESCRIBED PARCEL OF LAND AND THE SOUTHEAST CORNER OF LANDS NOW OR FORMERLY OF DAVIS; AND RUNNING THENCE, ALONG SAID COUNTY ROUTE 7A, THE FOLLOWING THREE (3) COURSES: 1.) S51° 49'29"W 91.34' (FEET) TO A POINT, 2.) N87° 08'34"W 39.56' (FEET) TO A POINT, 3.) N70° 14'16"W 40.71 (FEET) TO A POINT; THENCE, ALONG LANDS NOW OR FORMERLY OF GEISLER, THE FOLLOWING THREE (3) COURSES: 1.)
