BILL NUMBER: S6247 TITLE OF BILL : An act to amend part C of chapter 60 of the laws of 2014, amending the social services law and other laws relating to eliminating prescriber prevails for brand name drugs with generic equivalents, in relation to the establishment of a developmental disability clinician advisory group by the commissioner of health PURPOSE : To provide clarification relating to the establishment of a developmental disability clinician advisory group by the commissioner of health. SUMMARY OF PROVISIONS : Section 1 amends section 18 of part c of chapter 60 of the laws of 2014 to provide clarification on the purpose and intent of the establishment of a developmental disability clinician advisory group to provide the department of health with information and data on the effects of policies, including proposed regulations or statutes and of fiscal proposals including rate setting and appropriations on the delivery of supports and services for individuals with developmental disabilities.

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend part C of chapter 60 of the laws of 2014, amending the social services law and other laws relating to eliminating prescriber prevails for brand name drugs with generic equivalents, in relation to the establishment of a developmental disability clinician advisory group by the commissioner of health THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 18 of part C of chapter 60 of the laws of 2014, amending the social services law relating to eliminating prescriber prevails for brand name drugs with generic equivalents, is amended to read as follows: S 18. The commissioner of health is authorized to establish a DEVELOP- MENTAL disability clinician advisory group of experienced clinicians and clinic administrators who have an understanding of the comprehensive needs of people with DEVELOPMENTAL disabilities. Such group shall provide the commissioner and the department of health with information and data on the effect of policies, including proposed regulations or statutes, and of fiscal proposals, including rate setting and appropri- ations, on the delivery of supports and services for individuals with DEVELOPMENTAL disabilities including but not limited to the role of specialty services. SUCH GROUP SHALL CONSIST OF THE FOLLOWING PERSONS OR THEIR DESIGNEES: THE COMMISSIONER OF THE OFFICE OF PEOPLE WITH DEVELOP- MENTAL DISABILITIES, THE COMMISSIONER OF THE DEPARTMENT OF HEALTH, THREE INDIVIDUALS APPOINTED BY THE GOVERNOR, TWO INDIVIDUALS EACH BY THE TEMPORARY PRESIDENT OF THE SENATE AND BY THE SPEAKER OF THE ASSEMBLY. THE MEMBERS OF THE GROUP SHALL BE APPOINTED FOR A TERM OF TWO YEARS AND SHALL MEET AT LEAST THREE TIMES IN EACH FULL CALENDAR YEAR DURING THE FIRST TWO YEARS AND ADDITIONALLY UPON THE REQUEST OF THE COMMISSIONER OF THE DEPARTMENT OF HEALTH. THE MEMBERS OF THE GROUP SHALL RECEIVE NO COMPENSATION FOR THEIR SERVICES AS MEMBERS, BUT EACH SHALL BE ALLOWED EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
