S T A T E O F N E W Y O R K ________________________________________________________________________ 9870 I N A S S E M B L Y April 20, 2016 ___________ Introduced by M. of A. ROZIC -- read once and referred to the Committee on Governmental Employees AN ACT to amend the civil service law, in relation to the powers and duties of the president of the state civil service commission THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 7 of the civil service law is amended by adding a new subdivision 7 to read as follows: 7. THE PRESIDENT OF THE COMMISSION SHALL PREPARE AN ANNUAL REPORT ON OR BEFORE THE FIRST DAY OF EACH MARCH NEXT SUCCEEDING THE DATE ON WHICH THIS SUBDIVISION SHALL HAVE TAKEN EFFECT TO BE ISSUED TO THE SPEAKER OF THE ASSEMBLY AND THE TEMPORARY PRESIDENT OF THE SENATE. SUCH REPORT SHALL DETAIL THE FEASIBILITY OF PROGRAMS PERMITTING ALTERNATIVE WORK SCHEDULES AND FLEXIBLE WORK HOURS WITHIN STATE AGENCIES, AND SHALL PRES- ENT AN ANALYSIS OF HOW PROGRAMS FOR ALTERNATIVE WORK SCHEDULES AND FLEX- IBLE WORK HOURS FOR EMPLOYEES COULD BE IMPLEMENTED IN SUCH DEPARTMENT OR AGENCY INCLUDING, BUT NOT LIMITED TO, HOW MANY POSITIONS COULD BE INCOR- PORATED INTO SUCH PROGRAMS AND THE ADVANTAGES AND DISADVANTAGES OF SUCH PROGRAMS. HOWEVER, NO PLAN REGARDING ALTERNATIVE WORK SCHEDULES OR FLEX- IBLE WORK HOURS SHALL BE IMPLEMENTED AND CANNOT BE ENFORCED WITH REGARD TO EMPLOYEES REPRESENTED BY A BARGAINING UNIT UNLESS AND UNTIL SUCH PLAN IS IMPLEMENTED THROUGH A COLLECTIVE BARGAINING AGREEMENT. THE PRESIDENT SHALL COMPILE INPUT FROM EACH AGENCY RELATING TO SUCH ALTERNATIVE WORK SCHEDULES AND FLEXIBLE WORK HOURS AND CONSIDER HOW TO THE EXTENT POSSI- BLE THE SPECIFIC AGENCIES MAY BE MORE OR LESS ABLE TO ACCOMMODATE SUCH PROGRAMS.
