BILL NUMBER:S1971 TITLE OF BILL: An act to amend the executive law, in relation to distribution of the state register; and to repeal certain provisions of the executive law relating thereto PURPOSE: This bill would reduce state expenditures by eliminating requirements to provide free hard copies of the State Register to entities that prefer to access the free online version. SUMMARY OF PROVISIONS: Section 1. Repeals paragraph (c) of subdivision 1 of § 148 of the Executive Law, which requires the Department of State to write annually to city, town and village clerks to advise them that they may receive a copy of the weekly State Register upon written request of the governing body. Section 2. Amends subdivision 2 of § 148 of the Executive Law, and adds a new subdivision 4-a, providing that (a) the requirement to provide a free copy of the weekly Register to each state agency and legislator may be dispensed with upon request of the recipient, and (b) the authorization to charge a fee for the Register applies only to the paper version -the statute is amended to explicitly recognize the availability, at no cost, of an online version of the publication.

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to distribution of the state register; and to repeal certain provisions of the executive law relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph c of subdivision 1 of section 148 of the execu- tive law is REPEALED. S 2. Subdivision 2 of section 148 of the executive law, as amended by chapter 636 of the laws of 1981, is amended and a new subdivision 4-a is added to read as follows: 2. The department of state shall mail or otherwise deliver a copy of each regular issue and the quarterly index required by subdivision three of section one hundred forty-seven of this article to each agency and every state legislator, UNLESS THE AGENCY OR STATE LEGISLATOR HAS REQUESTED THAT THE DEPARTMENT DISCONTINUE SUCH DELIVERY, and shall provide notice and indicate the availability upon request of any special issue published pursuant to subdivision two of section one hundred forty-seven of this article by placing said notice in the regular issue appearing two weeks prior to the publication date of any such special issue. Such special issues shall be available to each agency and state legislator at no charge. 4-A. IN ADDITION TO THE STATE REGISTER, THE DEPARTMENT OF STATE SHALL MAKE AVAILABLE AT NO COST AN ONLINE VERSION OF THE WEEKLY STATE REGIS- TER, QUARTERLY INDEX AND ANY SPECIAL ISSUES AS DIRECTED BY STATUTE OR DEEMED APPROPRIATE BY THE SECRETARY OF STATE.
