                                BILL NUMBER:S4643

TITLE OF BILL:  An act to amend the state finance law, in relation to
providing state aid to municipalities to offset the costs and expenses
of providing public safety services that are necessary as a result of
the presence of a residential institution located in such municipality

PURPOSE:

To provide state aid to municipalities hosting four-year state
university of New York (SUNY) residential schools, colleges and
universities to help offset the costs of providing public safety
services to student populations.

SUMMARY OF PROVISIONS:

Section 1 provides definitions; sets forth a formula for the
distribution and use of state aid; and provides the date when such
payments will be made.

Section 2 provides the effective date.

JUSTIFICATION:

While it is considered amongst municipalities to be a privilege to
host four-year SUNY institutions, the enrichment and benefits provided

to host communities are not without costs that are borne by local
governments. Significant student populations presents several public
policy challenges for local governments, one of which is providing
adequate public safety services to both students and the public while
striking the appropriate balance between other municipal priorities
and available resources.

A recent study (forthcoming in the online journal of the New York
State Economics Association) concludes that host community residents
bear the cost of public safety services (through property taxation)
even though both students and the public are beneficiaries. The study
also points out that over the years, municipal finances have become
increasingly stressed due to growing numbers of tax exempt properties,
the flight of manufacturing jobs and human capital. These factors have
resulted in a proportionately high percentage of municipal budgets
devoted to public safety. Providing state aid for the costs associated
with police, fire and code enforcement services will allow local
governments to continue providing critical services without putting
other public services in jeopardy or placing additional financial
burdens on tax bases that have historically been shrinking.

AN ACT to amend the state finance law, in relation  to  providing  state
  aid  to  municipalities  to offset the costs and expenses of providing
  public safety services that are necessary as a result of the  presence
  of a residential institution located in such municipality

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The state finance law is amended by adding  a  new  section
54-m to read as follows:
  S 54-M. STATE AID TO OFFSET COSTS AND EXPENSES OF CERTAIN PUBLIC SAFE-
TY  SERVICES. 1. FOR PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL
HAVE THE FOLLOWING MEANINGS:
  A. "HOST MUNICIPALITY" SHALL MEAN A MUNICIPALITY IN WHICH  A  RESIDEN-
TIAL INSTITUTION IS LOCATED, EITHER IN WHOLE OR IN PART.
  B.  "RESIDENTIAL  INSTITUTION"  SHALL  MEAN  ANY FOUR YEAR RESIDENTIAL
SCHOOL, COLLEGE OR UNIVERSITY OF THE STATE UNIVERSITY OF NEW YORK.
  C. "MUNICIPALITY" SHALL MEAN A COUNTY, TOWN, CITY OR  VILLAGE  LOCATED
IN THIS STATE.
  2.  WITHIN  THE  AMOUNT  APPROPRIATED THEREFOR, EACH HOST MUNICIPALITY
SHALL RECEIVE AID ACCORDING TO THE  FORMULA  SET  FORTH  IN  SUBDIVISION
THREE OF THIS SECTION. AID RECEIVED BY A HOST MUNICIPALITY SHALL BE USED
BY SUCH HOST MUNICIPALITY AS FOLLOWS:
  A.  FIFTY  PERCENT  OF  SUCH  AID RECEIVED SHALL BE USED TO OFFSET THE
COSTS AND EXPENSES OF PROVIDING PUBLIC SAFETY SERVICES THAT  ARE  NECES-
SARY AS A RESULT OF THE PRESENCE OF A RESIDENTIAL INSTITUTION LOCATED IN
SUCH HOST MUNICIPALITY; AND
  B. FIFTY PERCENT OF SUCH AID RECEIVED SHALL BE USED TO REDUCE THE REAL
PROPERTY TAX LEVIED BY SUCH HOST MUNICIPALITY.
  3.  THE  AMOUNT OF AID MADE AVAILABLE TO A HOST MUNICIPALITY TO OFFSET
THE COSTS AND EXPENSES OF PROVIDING PUBLIC SAFETY SERVICES SHALL BE  THE

DIFFERENCE IN THE COST BETWEEN THE PER STUDENT COST FOR THE PROVISION OF
PUBLIC SAFETY SERVICES BY THE HOST MUNICIPALITY LESS ANY PER STUDENT AID
AND  INCENTIVES FOR MUNICIPALITIES FUNDING RECEIVED BY SUCH HOST MUNICI-
PALITY  FROM  THE STATE, MULTIPLIED BY THE STUDENT POPULATION IN ATTEND-
ANCE AT THE RESIDENTIAL INSTITUTION LOCATED IN SUCH  HOST  MUNICIPALITY.
IF  A  RESIDENTIAL  INSTITUTION  IS  LOCATED IN TWO OR MORE HOST MUNICI-
PALITIES, THE AMOUNT OF AID MADE AVAILABLE PURSUANT TO THIS  SUBDIVISION
SHALL  BE  DISTRIBUTED  AMONG  SUCH  HOST  MUNICIPALITIES PURSUANT TO AN
INTERMUNICIPAL AGREEMENT SETTING FORTH A DISTRIBUTION FORMULA THAT SHALL
BE APPROVED BY EACH OF THE  LEGISLATIVE  BODIES  OF  SUCH  HOST  MUNICI-
PALITIES.
  4.  PAYMENTS  MADE PURSUANT TO THIS SECTION SHALL BE MADE ON OR BEFORE
JULY FIRST OF EACH YEAR.
  S 2. This act shall take effect immediately.
