BILL NUMBER:S5400 TITLE OF BILL: An act to amend the public authorities law, in relation to directing the New York state thruway authority to establish a farm EZ pass which grants discounted tolls for certain motor vehicles used by persons engaged in agricultural production PURPOSE: Directs the New York state thruway authority to establish an electronic toll collection device for trucks used by farms, which grants a 10% discount for use of the thruway. SUMMARY OF PROVISIONS: Section 1: Adds a new section 378-b to the public authorities law. Section 2: Sets the effective date. JUSTIFICATION: There are many small farms that operate in New York State. Similar to other small businesses, they are struggling with rising costs to transport their products. This legislation seeks to help alleviate some of that burden by providing a ten percent discount on single unit trucks and other larger vehicles used to support farms activities. Currently the NYS Thruway Authority provides a ten percent discount on tolls to owners who drive certain low emission vehicles. It is not unreasonable or cost prohibitive to allow farmers the same discount.

AMEDORE -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the public authorities law, in relation to directing the New York state thruway authority to establish a farm EZ pass which grants discounted tolls for certain motor vehicles used by persons engaged in agricultural production THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public authorities law is amended by adding a new section 378-b to read as follows: S 378-B. FARM EZ PASS. 1. THE AUTHORITY SHALL ESTABLISHED AND ISSUE ELECTRONIC TOLL COLLECTION DEVICES FOR SINGLE UNIT TRUCKS AND TRUCKS HAVING TWO OR MORE AXLES WHICH ARE OWNED AND OPERATED BY A PERSON OR ENTITY ENGAGED IN THE PRODUCTION OF CROPS, LIVESTOCK AND LIVESTOCK PRODUCTS, AS DEFINED IN SUBDIVISION TWO OF SECTION THREE HUNDRED ONE OF THE AGRICULTURE AND MARKETS LAW, WHEN SUCH TRUCKS ARE USED EXCLUSIVELY TO FURTHER THE CONDUCTING OF SUCH PRODUCTION. THE USE OF SUCH ELECTRONIC TOLL COLLECTION DEVICES SHALL PROVIDE A TEN PERCENT DISCOUNT ON THE TOLL OTHERWISE IMPOSED FOR THE USE OF THE THRUWAY SYSTEM, OR ANY PORTION THEREOF, BY THE TRUCK TO WHICH THE DEVICE IS AFFIXED. 2. THE AUTHORITY SHALL PROMULGATE RULES AND REGULATIONS TO IMPLEMENT THE PROVISIONS OF THIS SECTION, INCLUDING ESTABLISHING THE TYPE OF DOCUMENTATION OR OTHER PROOF REQUIRED TO PROVE THAT A TRUCK IS EXCLU- SIVELY USED TO FURTHER THE CONDUCTING OF THE PRODUCTION OF CROPS, LIVE- STOCK AND LIVESTOCK PRODUCTS. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law; provided, however that, effective immediate- ly, any rules and regulations necessary to implement the provisions of this act on its effective date are authorized and directed to be completed on or before such date.
