AN ACT to amend the education law, in relation to authorizing the option
  of assigning community service as  an  alternative  to  suspension  of
  students or in conjunction thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 3214-a
to read as follows:
  S 3214-A. COMMUNITY SERVICE. AS AN ALTERNATIVE TO  OR  IN  CONJUNCTION
WITH THE PROVISIONS AUTHORIZED BY SECTION THIRTY-TWO HUNDRED FOURTEEN OF
THIS  ARTICLE,  A BOARD OF EDUCATION, BOARD OF TRUSTEES OR SOLE TRUSTEE,
THE SUPERINTENDENT OF SCHOOLS, DISTRICT  SUPERINTENDENT  OF  SCHOOLS  OR
PRINCIPAL  OF  A SCHOOL MAY REQUIRE A PUPIL TO PERFORM COMMUNITY SERVICE
WHEN, IN HIS OR HER DISCRETION, THE BOARD OF EDUCATION, BOARD  OF  TRUS-
TEES  OR  SOLE  TRUSTEE,  THE SUPERINTENDENT OF SCHOOLS, DISTRICT SUPER-
INTENDENT OF SCHOOLS OR PRINCIPAL OF A SCHOOL DEEMS THAT THE PERFORMANCE
OF SUCH COMMUNITY SERVICE IS APPROPRIATE.
  S 2. This act shall take effect immediately.

AN ACT to amend the education law, in relation to authorizing the option
  of assigning community service as  an  alternative  to  suspension  of
  students or in conjunction thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 3214-a
to read as follows:
  S 3214-A. COMMUNITY SERVICE. AS AN ALTERNATIVE TO  OR  IN  CONJUNCTION
WITH  THE SUSPENSION OF A PUPIL PURSUANT TO THE PROVISIONS OF PARAGRAPHS
B AND C OF SUBDIVISION THREE OF SECTION THIRTY-TWO HUNDRED  FOURTEEN  OF
THIS  ARTICLE,  THE  SUSPENDING  AUTHORITY MAY, WITH THE APPROVAL OF THE
PERSON IN PARENTAL  RELATION,  REQUIRE  A  PUPIL  TO  PERFORM  COMMUNITY
SERVICE  WHEN,  IN HIS OR HER DISCRETION, THE SUSPENDING AUTHORITY DEEMS
THAT THE PERFORMANCE OF  SUCH  COMMUNITY  SERVICE  IS  APPROPRIATE.  ANY
COMMUNITY  SERVICE  THAT  WOULD BE PERFORMED OUTSIDE THE SCHOOL SHALL BE
PERFORMED IN ACCORDANCE WITH A WRITTEN POLICY ADOPTED  BY  THE  SCHOOL'S
BOARD  OF EDUCATION, BOARD OF TRUSTEES OR SOLE TRUSTEE. THE COMMISSIONER
MAY DEVELOP MODEL GUIDELINES FOR THE  IMPOSITION  OF  COMMUNITY  SERVICE
REQUIREMENTS.
  S 2. This act shall take effect immediately.
