BILL NUMBER:S5666 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to the issuance of licenses to sell liquor at retail for consumption on the premises of certain bed and breakfast facilities and restaurants located on land used in agricultural production PURPOSE: To authorize the issuance of on-premises liquor licenses to bed and breakfasts and restaurants which are engaged in the promotion of agricultural tourism. SUMMARY OF PROVISIONS: Section 1: Amends Section 64 of the Alcoholic Beverage Control law to authorize the issuance of on-premises liquor licenses to bed and breakfasts located upon land used in agricultural production Section 2: Effective Date, JUSTIFICATION: This legislation seeks to promote agricultural tourism in New York State Frequently agricultural tourism destinations are farm or farm related properties that offer unique historical charm and appeal.

LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the alcoholic beverage control law, in relation to the issuance of licenses to sell liquor at retail for consumption on the premises of certain bed and breakfast facilities and restaurants located on land used in agricultural production THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5-a of section 64 of the alcoholic beverage control law, as added by chapter 480 of the laws of 2003, is amended and a new subdivision 5-b is added to read as follows: 5-a. (A) Notwithstanding the provisions of subdivision five of this section, a liquor license may be issued under this section to an estab- lishment designated and commonly known and operated as a "bed and break- fast" regardless of whether or not a restaurant is operated in such establishment, provided that such license shall only permit the sale of alcoholic beverages to overnight guests of such establishment. (B) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDIVI- SION, A LIQUOR LICENSE ISSUED TO AN ESTABLISHMENT DESIGNATED AND COMMON- LY KNOWN AND OPERATED AS A "BED AND BREAKFAST" WHICH IS LOCATED UPON LAND USED IN AGRICULTURAL PRODUCTION, AS DEFINED IN SUBDIVISION FOUR OF SECTION THREE HUNDRED ONE OF THE AGRICULTURE AND MARKETS LAW, SHALL AUTHORIZE THE SALE OF ALCOHOLIC BEVERAGES TO OVERNIGHT GUESTS OF SUCH ESTABLISHMENT, AND TO THE PUBLIC, WHO ARE NOT OVERNIGHT GUESTS, DURING AGRICULTURAL TOURISM EVENTS (SUCH AS HARVEST FESTIVALS) AND FARM THEMED GOURMET DINING EXPERIENCES HOSTED BY SUCH ESTABLISHMENT. 5-B. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION FIVE OF THIS SECTION, A LIQUOR LICENSE MAY BE ISSUED UNDER THIS SECTION TO AN ESTAB- LISHMENT WHICH SELLS FOOD AND BEVERAGES TO THE PUBLIC, BUT DOES NOT HAVE REGULAR HOURS WHEN SUCH ESTABLISHMENT IS OPEN TO THE PUBLIC, AND IS EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
