BILL NUMBER: S7914 TITLE OF BILL : An act to amend the executive law, in relation to adding the Ellicott Creek located in Erie county to the definition of inland waterways PURPOSE : Designates Ellicott Creek located in Erie County as an inland waterway. SUMMARY OF PROVISIONS : Section 1 - amends paragraph (c) of subdivision 4 of section 911 of the Executive Law by adding Ellicott Creek, located in Erie County to the definition of "inland waterways." Section 2 - contains the effective date. JUSTIFICATION : The headwaters of Ellicott Creek begin in eastern Erie County, and flow westerly to finally end at the Erie Canal and Tonawanda Creek near their confluence with the Niagara River. The creek flows through the Towns of Alden, Lancaster, Cheektowaga, Amherst and Tonawanda. It

RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to adding the Ellicott Creek located in Erie county to the definition of inland waterways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 4 of section 911 of the execu- tive law, as amended by chapter 98 of the laws of 2015, is amended to read as follows: (c) the state's major creeks comprised of the 18 Mile Creek located in Erie county, Bushkill, Cattaraugus, Cincinnati, East Kill, Esopus (including upper and lower branches), Fish (including east and west branches), Gooseberry, Little Sandy, Onondaga, Sandy, Schoharie, South Sandy, Oatka, Tonawanda, West Kill, Scajaquada, Wappinger, ELLICOTT CREEK LOCATED IN ERIE COUNTY and Wynantskill; S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15513-02-6
