                                 BILL NUMBER:  S8103

 TITLE OF BILL :  An act authorizing the alienation of certain
parklands in the town of Islip, county of Suffolk

 PURPOSE :

This bill authorizes the town of Islip to alienate and replace
parkland.

 SUMMARY OF SPECIFIC PROVISIONS :

Section 1. Provides the town of Islip's governing body authority to
discontinue as parklands and alienate the land described in section 3.

Section 2. Requires the town of Islip to replace the alienated
parkland with the land described in section 4.

Section 3. Provides the metes and bounds description of the parkland
being alienated.

Section 4. Provides the metes and bounds description of the land that
will be used to replace the current park.

Section 5. Requires the town to dedicate the difference of the fair
market value of the lands to be alienated and the lands to be

dedicated for the acquisition of additional parklands and/or capital
improvements in the event that the parklands to be acquired and
dedicated are not of equal or greater fair market value.

Section 6. Requires the town of Islip to comply with federal law.

Section 7. Provides for an immediate effective date.

 JUSTIFICATION :

Town of Islip and the Central Islip Civil Council have requested
permission to alienate a small, 1.28 acre, park on Lowell Avenue in
Islip. The park land will be replaced with land which is approximately
102 square feet larger, and which is across the street from the
current park. The town has indicated that the parkland being alienated
will developed and used for the purpose of constructing new homes for
veterans.

AN ACT authorizing the alienation of certain parklands in  the  town  of
  Islip, county of Suffolk

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subject to the provisions of this act, the town  of  Islip,
acting by and through its town board, is hereby authorized to discontin-
ue  as  parklands  and alienate the lands more particularly described in
section three of this act, and to sell and convey  such  parklands  upon
such terms and conditions as determined by the town board of Islip.
  S 2. The authorization contained in section one of this act shall only
be  effective on the condition that the town of Islip shall dedicate the
lands described in section four of this act as  additional  parkland  of
the town.
  S  3.  The  land  to  be  discontinued  as  parkland and alienated and
conveyed is bounded and described as follows:
  BEGINNING AT A POINT, said point being 125 ft. east  from  the  inter-
section  formed from the easterly side of Lowell Ave. and the north side
of Cypress Ave.
  RUNNING THENCE in a northerly direction N7°40'00"W 233.00  feet  to  a
point;
  RUNNING  THENCE  in  an easterly directly N82°20"00"E 125.00 feet to a
point;
  RUNNING THENCE in a northerly direction N7°40"00"W  33.00  feet  to  a
point;
  RUNNING  THENCE  in an easterly direction N82°20'00"E 100.00 feet to a
point;
  RUNNING THENCE in a southerly direction S7°40'00"E 266.00  feet  to  a
point;
  RUNNING  THENCE  in  a  westerly  direction S82°20'00"W 225.00 feet to
point or place of beginning. The said parcel containing 1.2 acres ±.

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

  S 4. The town of Islip, acting by  and  through  its  governing  body,
shall  dedicate  the  replacement  lands, for use as parkland for public
park purposes consisting of 1.28 acres described as follows:
  BEGINNING  AT A POINT, said point being 1585.27 feet south from inter-
section formed by the west side of Lowell Avenue and the south  side  of
Clayton Avenue:
  RUNNING  THENCE  in  a westerly direction S82°20'22"W 500.71 feet to a
point;
  RUNNING THENCE in a northerly direction  N9°01'29"W 101.18 feet  to  a
point;
  RUNNING  THENCE  in  a easterly direction N82°20'22"W 533.12 feet to a
point;
  RUNNING THENCE in a southerly direction S07°39'38"E 101.18 feet to the
point or place of beginning.
  S 5. In the event that the parklands to be acquired and  dedicated  by
the  town of Islip pursuant to this act are not of equal or greater fair
market value to the parklands to be discontinued and conveyed, the  town
of  Islip  shall dedicate the difference of the fair market value of the
lands to be alienated and the lands to be dedicated for the  acquisition
of additional parklands and/or for capital improvements to existing park
and recreational facilities.
  S  6. If the land that is the subject of this act has received funding
pursuant to the federal land and water conservation fund, the discontin-
uance of parklands authorized by the provisions of this  act  shall  not
occur  until the municipality has complied with the federal requirements
pertaining to the conversion  of  parklands,  including  satisfying  the
secretary  of  the  interior  that  the  discontinuance will include all
conditions which the secretary of the interior deems necessary to assure
the substitution of other lands shall be equivalent in fair market value
and recreational usefulness to the lands being discontinued.
  S 7. This act shall take effect immediately.
