BILL NUMBER: S5884 TITLE OF BILL : An act to amend the public health law, in relation to designating certain opiates as schedule I and II substances; and to repeal certain provisions of such law relating thereto PURPOSE : This bill adds six new derivatives of fentanyl to the controlled substance Schedule. SUMMARY OF SPECIFIC PROVISIONS : Section one of the bill adds five new fentanyl derivatives to Schedule I, bringing New York's schedule in line with the current Federal Schedule. Section two of the bill adds a new fentanyl derivative to Schedule II. Section three of this bill is the effective date. JUSTIFICATION : Fentanyl and fentanyl-combined drugs are a major driver of the many recent overdoses that have occurred across New York State. It is important as a matter of public health and safety to properly regulate

Subdivision (b) of schedule I of section 3306 of the public health law is amended by adding five new paragraphs 56, 57, 58, 59 and 60 to read as follows: (56) N-(1-PHENETHYLPIPERDIN-4-YL)-N-PHENYLFURAN-2-CARBOXAMIDE (FURANYL FENTANYL). (57) N-PHENYL-N-{1-(2-PHENYLETHYL)-4-PIPERIDINYL}-PENTANAMIDE (VALERYL FENTANYL, PENTANOYL FENTANYL, PENTANYL FENTANYL). (58) U-47700(3,4-DICHLORO-N-(2-(DIMETHYLAMINO)CYCLOHEXYL)-N-METHYL-BEN- ZAMIDE)YL. (59) 4-CHLORO-N-{1-{2-(4-NITROPHENYL)ETHYL}-2-PIPERIDINYLIDENE}-BENZENE- SULFONAMIDE (W18). (60) CARFENTANIL. § 2. Subdivision (c) of schedule II of section 3306 of the public health law is amended by adding a new paragraph 29 to read as follows: (29) 4-(METHOXYCARBONYL)-4-(N-PHENMETHOXYACETAMIDO)-1-{2-(THIENYL) ETHYL}PIPERIDINE(THIAFENTANIL). § 3. Paragraph 6 of subdivision (c) of schedule II of section 3306 of the public health law is REPEALED. § 4. This act shall take effect immediately.
