 AN ACT to amend the  environmental  conservation  law,  in  relation  to

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The environmental conservation law is amended by  adding  a
 new section 19-0329 to read as follows:
 § 19-0329. CERTAIN FUEL OIL; PROHIBITED.
   1. ON AND AFTER JANUARY FIRST, TWO THOUSAND TWENTY-THREE, NO FUEL OIL,
 GRADE  NUMBER SIX, AS CLASSIFIED BY AMERICAN SOCIETY FOR TESTING MATERI-
 ALS STANDARD D396-15C, SHALL BE USED IN ANY BUILDING OR  FACILITY  OWNED
 OR OPERATED BY THE STATE, OR ANY AGENCY THEREOF.
   2. ON AND AFTER JANUARY FIRST, TWO THOUSAND TWENTY-EIGHT, NO FUEL OIL,
 GRADE NUMBER FOUR, AS CLASSIFIED BY AMERICAN SOCIETY FOR TESTING MATERI-

TITLE OF BILL:  An act to amend the environmental conservation law, in
relation to prohibiting the use of certain heating oils in state, county
and local government owned buildings

 
PURPOSE:

To phase out the use of heating oil fuel in grades 4 and 6 in state,
county and local government owned buildings.

 
SUMMARY OF PROVISIONS:

Section One - The Environment conservation Law is amended by adding a
new section 19-0329 to define the terms heating oil and heating system.
In addition, this new section requires the State of New York to
completely phase out the use of fuel grades 4 and 6 over a 10-year peri-
od in all state, county and local government owned buildings.

JUSTIFICATION:

Harmful pollutants are released into the air when fuel oil grades number
4 and number 6 are used to heat buildings. Both fuel number 4 and fuel
number 6 contain high concentrations contaminants, such as polycyclic
aromatic hydrocarbons (PAHs), heavy metals, nitric oxide, sulfur diox-
ide, nickel, and black carbon. PAHs are proven human carcinogens and
sulfur dioxide and nitric oxide are known respiratory irritants. Studies
show combustion of heating fuels number 4 and 6 form soot that is
composed of a complex mix of toxic pollutants. Soot is a black, carbona-
ceous substance produced during incomplete combustion of these oils; it
is conveyed into the atmosphere creating a source of air pollution and
contributing to respiratory illness.  Because soot is made of fine
airborne particles less than 2.5 microns in diameter, it is easily
inhaled. The toxic soot can penetrate deep into the lungs, cross the
blood stream, and get into organs, causing a multitude of health prob-
lems for people of all ages.

Infants, children, and the elderly are particularly vulnerable to
diseases caused by air pollution, including but not limited to asthma,
bronchitis, cancer, heart disease, and pneumonia. In 2011, New York City
required their buildings to change over to a cleaner fuel oil and West-
chester County has already passed a local law phasing out all use of
both fuels by 2020. This bill would prohibit the use of fuel oil grades
number 4 and number 6 in any buildings owned by any municipality, coun-
ty, or state government in New York State. The prohibition would be
phased in over a period of ten years, which is more than enough time to
accomplish this important environmental change especially in light of
the fact that counties and localities are taking it upon themselves to
enact this change in an even more expedited manner.

   Section  1.  The environmental conservation law is amended by adding a
 new section 19-0329 to read as follows:
 § 19-0329. HEATING OIL REQUIREMENTS FOR GOVERNMENT OWNED BUILDINGS.
   (1) DEFINITIONS. FOR THE PURPOSE OF THIS SECTION, THE FOLLOWING  TERMS
 SHALL HAVE THE FOLLOWING MEANINGS:
   (A) "HEATING OIL" MEANS OIL REFINED FOR THE PURPOSE OF USE AS FUEL FOR
 COMBUSTION IN A HEATING SYSTEM AND THAT MEETS THE SPECIFICATIONS OF ASTM
 DESIGNATION  D  396-12  OR  OTHER  SPECIFICATIONS  AS  DETERMINED BY THE
 COMMISSION.
   (B) "HEATING SYSTEM" MEANS A SYSTEM THAT GENERATES HEAT, HOT AIR,  HOT
 WATER  OR  STEAM  BY  COMBUSTION  AND  DISTRIBUTES IT WITHIN A BUILDING,
 PROVIDED THAT "HEATING SYSTEM" SHALL NOT INCLUDE WOOD BURNING STOVES.
   (2)(A) NO PERSON SHALL CAUSE OR PERMIT THE USE IN ANY STATE, COUNTY OR
 LOCAL GOVERNMENT OWNED BUILDING OR DELIVERY  TO  ANY  STATE,  COUNTY  OR
 LOCAL  GOVERNMENT  OWNED  BUILDING FOR USE IN SUCH BUILDING, HEATING OIL
 THAT IS FUEL OIL GRADE NO. 6 IN AN AMOUNT:
   (I) GREATER THAN EIGHTY PERCENT OF THE HEATING OIL FOR SUCH  BUILDING,
 ON AND AFTER JULY FIRST, TWO THOUSAND NINETEEN;
   (II)  GREATER THAN SIXTY PERCENT OF THE HEATING OIL FOR SUCH BUILDING,
 ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY;
   (III) GREATER THAN FORTY PERCENT OF THE HEATING OIL FOR SUCH BUILDING,
 ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY-ONE; AND
   (IV) GREATER THAN TWENTY PERCENT OF THE HEATING OIL FOR SUCH BUILDING,
 ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY-TWO.

   (VIII)  GREATER THAN TWENTY PERCENT OF THE HEATING OIL FOR SUCH BUILD-
 ING, ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY-SIX; AND
   (IX) GREATER THAN TEN PERCENT OF THE HEATING OIL FOR SUCH BUILDING, ON
 AND AFTER JULY FIRST, TWO THOUSAND TWENTY-SEVEN.
   (B) ON AND AFTER JULY FIRST, TWO THOUSAND TWENTY-EIGHT NO PERSON SHALL
 CAUSE OR PERMIT THE USE IN ANY STATE, COUNTY OR LOCAL  GOVERNMENT  OWNED
 BUILDING  OR  DELIVERY  TO  ANY  STATE, COUNTY OR LOCAL GOVERNMENT OWNED
 BUILDING FOR USE IN SUCH BUILDING, HEATING OIL THAT IS  FUEL  OIL  GRADE
 NO. 4 IN ANY AMOUNT.
   (4)  THE  GOVERNOR  MAY,  BY  ISSUING  AN EXECUTIVE ORDER, TEMPORARILY
 SUSPEND THE APPLICABILITY OF THIS SECTION  AT  ANY  TIME  BASED  ON  THE
 GOVERNOR'S DETERMINATION, AFTER CONSULTING WITH THE NEW YORK STATE ENER-
 GY  RESEARCH  AND DEVELOPMENT AUTHORITY AND THE DEPARTMENT, THAT MEETING
 THE REQUIREMENTS OF SUBDIVISION TWO OR SUBDIVISION THREE OF THIS SECTION
 IS NOT FEASIBLE DUE TO LACK OF ADEQUATE SUPPLY OF HEATING  OIL  OR  THAT
 MEETING  THE REQUIREMENT WOULD RESULT IN UNDUE FINANCIAL HARDSHIP TO THE
 STATE, COUNTY OR LOCAL GOVERNMENTS.
   § 2. This act shall take effect immediately.
