 AN ACT to authorize the town of Yorktown, in the county  of  Westchester
   to alienate certain parklands
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subject to the provisions of this act, the town of Yorktown
 in the county of Westchester, is hereby authorized to discontinue use as
 and alienate the parklands described in section four of this act.
   § 2. Notwithstanding the failure of the town of  Yorktown  to  receive
 authorization by law to alienate the parklands described in section four
 of  this act prior to such parklands being alienated, such alienation is
 hereby validated, legalized, ratified and confirmed.
   § 3. The authorization granted in section one of  this  act  shall  be
 subject  to the requirement that all proceeds from the sale of the park-
 lands described in section four of this act shall be used for the acqui-
 sition of additional parkland and/or for capital improvements to  exist-
 ing park and recreational facilities.
   §  4. The parklands authorized by section one of this act to be alien-
 ated are described as follows:
   All that certain plot, piece or parcel of land, being in the  Incorpo-
 rated  Town  of  Yorktown,  County of Westchester and State of New York,
 bounded and described as follows:
   BEGINNING at a point on the easterly side of Illington Road where  the
 same  is  intersected  by  the northern boundary line of now or formerly
 Kuchenmeister
   THENCE running  along  the  easterly  side  of  Illington  Road  in  a
 northeasterly direction and
   THENCE following the stone wall a distance of 420 feet
   THENCE  still continuing along said easterly side of Illington Road as
 same bears to the left in a northerly direction
   THENCE following the stone wall a distance of 780 feet to  the  inter-
 section  of said easterly side of Illington Road with the southerly side
 of the Old Croton Dam Road

 AN  ACT  to authorize the town of Yorktown, in the county of Westchester
   to alienate certain parklands
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subject to the provisions of this act, the town of Yorktown
 in  the  county of Westchester, acting by and through its governing body
 and upon such terms and conditions as determined by such board is hereby
 authorized to discontinue as parklands and alienate the lands  described
 in  section  three of this act that are unusable for public recreational
 purposes.
   § 2. The authorization contained in section one of this act shall take
 effect only upon the condition that the town of Yorktown shall  dedicate
 an  amount  equal  to or greater than the fair market value of the park-
 lands being discontinued towards the acquisition of new parklands and/or
 towards capital  improvements  to  existing  parkland  and  recreational
 facilities.
   §  3. The parklands authorized by section one of this act to be alien-
 ated are described as follows:
