S T A T E O F N E W Y O R K ________________________________________________________________________ 6903 2017-2018 Regular Sessions I N A S S E M B L Y March 24, 2017 ___________ Introduced by M. of A. BRINDISI -- read once and referred to the Commit- tee on Children and Families AN ACT to amend the executive law, in relation to the creation of a study by the commissioner of the office of children and family services regarding staffing levels THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 500 of the executive law is amended by adding a new subdivision 2-a to read as follows: 2-A. THE COMMISSIONER SHALL ESTABLISH AND CONDUCT AN ANNUAL STUDY, TO BE DELIVERED TO THE LEGISLATURE ON OR BEFORE THE FIRST OF JANUARY OF EACH YEAR, ON FACILITIES OPERATED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES REGARDING THE RATIO OF NON-ADMINISTRATIVE STAFF TO RESIDENTS. IT SHALL BE NOTED IN THESE ANNUAL STUDIES THE NUMBER OF EMPLOYEES WHO ARE CURRENTLY OUT OF DUTY DUE TO AN ON THE JOB INCIDENT AND ARE CURRENT- LY ON WORKERS' COMPENSATION LEAVE. THESE ANNUAL STUDIES SHALL ALSO INCLUDE THE NUMBER OF STAFF, SPECIFICALLY DESCRIBING THEIR POSITIONS, WHO ARE INVOLVED IN ANY REPORTED INCIDENT INVOLVING THE MISCONDUCT OF A RESIDENT AND A COMPARISON OF THIS DATA TO OTHER OFFICE OF CHILDREN AND FAMILY SERVICES FACILITIES OF SIMILAR SIZE AND A SIMILAR TYPE AS WELL AS THE DATE AND TIME OF SUCH INCIDENTS. § 2. (A) SUCH STUDY SHALL INCLUDE (I) THE RATIO OF NON-ADMINISTRATIVE STAFF TO RESIDENTS; (II) THE TOTAL NUMBER OF EMPLOYEES COMPARED TO THE NUMBER OF EMPLOYEES WHO WERE ON WORKERS' COMPENSATION LEAVE; (III) THE NUMBER OF STAFF INVOLVED IN ANY REPORTED INCIDENT INVOLVING THE ALLEGED MISCON- DUCT OF A RESIDENT, INCLUDING THE TITLE OF SUCH STAFF; AND (IV) ANY OTHER INFORMATION THE COMMISSIONER DEEMS RELEVANT. (B) UTILIZING THE INFORMATION REQUIRED BY PARAGRAPH (A) OF THIS SUBDI- VISION FOR EACH FACILITY OPERATED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES, THE COMMISSIONER SHALL SUBMIT A REPORT TO THE LEGISLATURE NO LATER THAN JANUARY FIRST OF EACH YEAR. § 2.
