 AN  ACT  to  amend  the education law, in relation to permitting certain
   physicians to practice medicine in New York state if they are licensed
   to practice in another state within the country

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  6526 of the education law is amended by adding a
 new subdivision 10 to read as follows:
   10. (A) ANY PHYSICIAN WHO IS LICENSED AND  IN  GOOD  STANDING  IN  ANY
 STATE WITHIN THE UNITED STATES WHO:
   (I) HAS A WRITTEN OR ORAL AGREEMENT WITH A SPORTS TEAM TO PROVIDE CARE
 TO TEAM MEMBERS AND COACHING STAFF TRAVELING WITH THE TEAM FOR A SPECIF-
 IC SPORTING EVENT TO TAKE PLACE IN THIS STATE; OR
   (II)  HAS  BEEN  INVITED BY A NATIONAL SPORT GOVERNING BODY TO PROVIDE
 SERVICES TO TEAM MEMBERS AND COACHING STAFF AT A NATIONAL SPORT TRAINING
 CENTER IN THIS STATE OR TO PROVIDE SERVICES AT AN EVENT  OR  COMPETITION
 IN  THIS  STATE WHICH IS SANCTIONED BY THE NATIONAL SPORT GOVERNING BODY
 SO LONG AS:
   (A) THE PHYSICIAN'S PRACTICE  IS  LIMITED  TO  THAT  REQUIRED  BY  THE
 NATIONAL SPORT GOVERNING BODY; AND
   (B)  THE SERVICES PROVIDED BY THE PHYSICIAN ARE WITHIN THE PHYSICIAN'S
 SCOPE OF PRACTICE.
   (B) NOTHING IN THIS SUBDIVISION SHALL BE  CONSTRUED  AS  TO  PERMIT  A
 PHYSICIAN EXEMPT BY THE PROVISIONS OF THIS SUBDIVISION TO:
   (I) PROVIDE CARE OR CONSULTATION TO ANY PERSON RESIDING IN THIS STATE,
 OTHER THAN A PERSON SPECIFIED IN PARAGRAPH (A) OF THIS SUBDIVISION; OR
   (II) PRACTICE AT A LICENSED HEALTH CARE FACILITY IN THIS STATE.
   (C)  AN EXEMPTION OBTAINED PURSUANT TO THE PROVISIONS OF THIS SUBDIVI-
 SION SHALL BE VALID WHILE THE PHYSICIAN IS  TRAVELING  WITH  THE  SPORTS
 TEAM,  PROVIDED  NO  EXEMPTION SHALL BE LONGER THAN TEN DAYS IN DURATION

 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 6526 of the education law is amended  by  adding  a
 new subdivision 10 to read as follows:
   10.  (A) ANY PHYSICIAN WHO IS LICENSED AND IN GOOD STANDING IN ANOTHER
 STATE OR TERRITORY, AND WHO HAS A WRITTEN AGREEMENT TO  PROVIDE  MEDICAL
 SERVICES TO ATHLETES AND TEAM PERSONNEL OF A NATIONAL GOVERNING BODY FOR
 A  SPORT IN THE UNITED STATES AS DESIGNATED BY THE UNITED STATES OLYMPIC
 COMMITTEE OR AN OUT-OF-STATE SECONDARY SCHOOL, INSTITUTION OF POSTSECON-
 DARY EDUCATION, OR PROFESSIONAL ATHLETIC ORGANIZATION SPORTS  TEAM,  MAY
 PROVIDE  MEDICAL  SERVICES  TO  SUCH  ATHLETES  AND  TEAM PERSONNEL AT A
 DISCRETE SANCTIONED TEAM SPORTING EVENT IN THIS STATE AS DEFINED BY  THE
 COMMISSIONER IN REGULATIONS, PROVIDED SUCH SERVICES ARE PROVIDED ONLY TO
 SUCH  ATHLETES AND TEAM PERSONNEL AT THE DISCRETE SANCTIONED TEAM SPORT-
 ING EVENT. ANY SUCH MEDICAL SERVICES SHALL BE PROVIDED  ONLY  FIVE  DAYS
 BEFORE  THROUGH  ONE  DAY  AFTER  EACH DISCRETE SANCTIONED TEAM SPORTING
 EVENT.
   (B) ANY PERSON PRACTICING AS A PHYSICIAN IN NEW YORK STATE PURSUANT TO
 THIS SUBDIVISION SHALL BE SUBJECT TO THE  PERSONAL  AND  SUBJECT  MATTER
 JURISDICTION  AND  DISCIPLINARY AND REGULATORY AUTHORITY OF THE BOARD OF
 REGENTS AS IF HE OR SHE IS A LICENSEE AND AS IF THE  EXEMPTION  PURSUANT
 TO  THIS  SUBDIVISION  IS  A  LICENSE. SUCH INDIVIDUAL SHALL COMPLY WITH

 RECOGNIZED  BY  THE  UNITED  STATES OLYMPIC COMMITTEE OR AN OUT-OF-STATE
 SECONDARY SCHOOL, INSTITUTION OF  POSTSECONDARY  EDUCATION,  OR  PROFES-
 SIONAL  ATHLETIC  ORGANIZATION SPORTS TEAM, MAY PROVIDE MEDICAL SERVICES
 TO SUCH ATHLETES AND TEAM PERSONNEL AT A DISCRETE SANCTIONED TEAM SPORT-
 ING EVENT IN THIS STATE AS DEFINED BY THE COMMISSIONER  IN  REGULATIONS,
 PROVIDED  SUCH  SERVICES  ARE  PROVIDED  ONLY  TO SUCH ATHLETES AND TEAM
 PERSONNEL AT THE DISCRETE  SANCTIONED  TEAM  SPORTING  EVENT.  ANY  SUCH
 MEDICAL  SERVICES  SHALL BE PROVIDED ONLY FIVE DAYS BEFORE THROUGH THREE
 DAYS AFTER EACH DISCRETE SANCTIONED TEAM SPORTING EVENT.
   (B) ANY PERSON PRACTICING AS A PHYSICIAN IN NEW YORK STATE PURSUANT TO
 THIS SUBDIVISION SHALL BE SUBJECT TO THE  PERSONAL  AND  SUBJECT  MATTER
 JURISDICTION  AND  DISCIPLINARY AND REGULATORY AUTHORITY OF THE BOARD OF
 REGENTS AS IF HE OR SHE IS A LICENSEE AND AS IF THE  EXEMPTION  PURSUANT
