 AN ACT to amend the administrative code of the  city  of  New  York,  in
   relation  to directing the department of transportation of the city of
   New York to study and report on its current  and  planned  efforts  to
   educate  pedestrians  and  drivers  relating to being distracted while
   using a mobile device; and providing for the repeal of such provisions
   upon expiration thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The administrative code of the city of New York is amended
 by adding a new section 19-197 to read as follows:
   § 19-197 DEPARTMENT REPORT ON DISTRACTED PEDESTRIANS.  THE  DEPARTMENT
 SHALL  STUDY  AND  PRODUCE  A  REPORT  REGARDING ITS CURRENT AND PLANNED
 EFFORTS TO EDUCATE PEDESTRIANS AND DRIVERS OF:
   1. THE DANGERS INHERENT IN ACTING AS A PEDESTRIAN WHILE DISTRACTED  BY
 TEXTING, OR OTHER USES OF A MOBILE DEVICE; AND
   2.  THE  NECESSITY  OF OPERATORS OF MOTOR VEHICLES TO EXERCISE CARE IN
 WATCHING FOR PEDESTRIANS WHO ARE DISTRACTED BY TEXTING, OR OTHER USES OF
 A MOBILE DEVICE, REGARDLESS OF  WHETHER  A  PEDESTRIAN  IS  UTILIZING  A
 DEFINED STREET CROSSING.
   SUCH STUDY AND REPORT SHALL DETAIL THE DEPARTMENT'S COMMUNICATIONS, ON
 A  CITYWIDE BASIS, THAT EDUCATE PEDESTRIANS ABOUT THE DANGERS OF USING A
 MOBILE DEVICE WHILE TRAVERSING AN INTERSECTION, AND THE DANGERS OF USING
 A MOBILE DEVICE WHILE BEING NEAR OR IN A STREET  AND  SHALL  PROVIDE  AN
 ANALYSIS  OF  THE EFFECTIVENESS OF SUCH COMMUNICATIONS. THE REPORT SHALL
 FURTHER PROVIDE RECOMMENDATIONS  RELATIVE  TO  PREVENTING  FUTURE  MOTOR
 VEHICLE CRASHES INVOLVING PEDESTRIANS WHO ARE UTILIZING A MOBILE DEVICE.
 THE  DEPARTMENT  SHALL  SUBMIT ITS REPORT TO THE GOVERNOR, THE TEMPORARY
 PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, THE MAYOR AND  THE
 SPEAKER OF THE CITY COUNCIL.
