BILL NUMBER: S3691 TITLE OF BILL : An act to amend the general municipal law, in relation to the placing of a lien for unpaid property taxes against the proceeds of a fire insurance policy on any real property located within a municipality PURPOSE OR GENERAL IDEA OF BILL : To expand the definition of real property under the general municipal law to include one and two family residential structures such that municipalities may impose a tax lien upon an owner's fire insurance policy in the event that the owner does not remedy damage to their property. SUMMARY OF SPECIFIC PROVISIONS : Section 1. Amends paragraph (e) of subdivision 1 of section 22 of the general municipal law, as added by chapter 569 of the laws of 1978, to include one and two family structures in the definition of real property. Paragraph (e) of subdivision 1 of section 22 of the general municipal law, as added by chapter 569 of the laws of 1978, is amended to read as follows: (e) "Real property" means property upon which there is erected any residential, commercial or industrial building or structure except a one or two OWNER-OCCUPIED family residential structure. § 2.
