 TITLE OF BILL :  An act to authorize Kimberly A. Cooney to take the
competitive civil service examination and be placed on the eligible
list for appointment as a full-time police officer for the City of
Mechanicville, County of Saratoga

 PURPOSE :

Authorizes Kimberly A. Cooney to take the competitive exam for police
officer and be placed on the eligible list for such position in the
City of Mechanicville.

 SUMMARY OF PROVISIONS :

Section 1: Authorizes Kimberly A. Cooney to sit for the civil service
exam and be placed on the eligibility list for full time police
officer for the City of Mechanicville.

Section 2: Establishes the effective date as immediately.

 JUSTIFICATION :

Due to the provisions under the Civil Service Law, the City of
Mechanicville has requested legislation to permit one of their
part-time officers, Kimberly A. Cooney, to be eligible to take the

civil service examination since she is currently older than 35 years
old.

Recruiting and retaining well-qualified full time police officers is
challenging for small and rural police departments. At the request of
the Mayor of the City of Mechanicville and the Chief of Police, and by
resolution of the City Council, this bill would address this issue by
allowing a part time police officer of the City of Mechanicville
Police Department to be eligible for full time status. While age
restrictions certainly have practical value, they do not always
reflect the ability of some candidates to perform full time police
duties. According to the Chief of Police, Officer Cooney (part time
since 2016) is perfectly competent to perform the duties required of a
full time police officer, rating her skills as "exemplary" even
outperforming some of her younger coworkers.

   printed to be committed to the Committee on Civil Service and Pensions
 
 AN  ACT  to  authorize  Kimberly A. Cooney to take the competitive civil
   service examination and be placed on the eligible list for appointment
   as a full-time police officer for the City of Mechanicville, County of
   Saratoga
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Notwithstanding the provisions of section 58 of the civil
 service law, or any other law to the contrary, Kimberly  A.  Cooney  who
 has  been  continuously  employed  by  the City of Mechanicville, in the
 County of Saratoga, as a part-time police officer, shall be eligible  to
 take  the  competitive  civil  service  examination  for the position of
 police officer and shall, contingent upon her score on such examination,
 be eligible to be placed on the eligible list for appointment as a full-
 time police officer for the City of Mechanicville.
   Kimberly A. Cooney shall otherwise be subject to the merit and fitness
 provisions of the civil service law applicable to full-time police offi-
 cers.
   § 2. This act shall take effect immediately.
