BILL NUMBER: S3974 TITLE OF BILL : An act to amend the executive law and the general municipal law, in relation to prohibiting the provision of assistance in the enforcement of a certain United States Executive Order relating to border security and immigration, within the state PURPOSE : To prohibit the state from providing any resources in enforcement of the unjust executive order resulting in the detention of immigrants. SUMMARY OF PROVISIONS : Section 1 prohibits the Port Authority from expending any resources to assist with the enforcement of the President's Executive Order of January 25, 2017 Section 2 provides that this shall only apply to Port Authority actions within the boundaries of the state of New York Section 3 amends the executive law, adding a new section 233 preventing any member of the state police from assisting in enforcement of the executive order Section 4 amends the general municipal law, adding a new section 205-h

GIANARIS, HOYLMAN, PARKER, SANDERS -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law and the general municipal law, in relation to prohibiting the provision of assistance in the enforcement of a certain United States Executive Order relating to border security and immigration, within the state THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary, no employee or officer of the port authority of New York and New Jersey shall provide any aid, resources, assistance, or support to any federal employee or representative in enforcing the provisions of a United States Executive Order enacted on January 25, 2017 regarding Border Security and Immigration Enforcement Improvements, nor may any resources or facilities of the port authority of New York and New Jersey be used for such purpose. § 2. The provisions of this act shall only apply to any employees or officers of the port authority of New York and New Jersey working within the boundaries of the state of New York and shall only apply on proper- ties wholly within the boundaries of the state of New York. § 3. The executive law is amended by adding a new section 233 to read as follows: § 233. PORT AUTHORITY IMMIGRATION PARTICIPATION. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, NO MEMBER OF THE DIVISION OF STATE POLICE SHALL PROVIDE ANY AID, RESOURCES, ASSISTANCE OR SUPPORT TO ANY FEDERAL EMPLOYEE OR REPRESENTATIVE ENFORCING THE PROVISIONS OF A UNITED STATES EXECUTIVE ORDER ENACTED ON JANUARY TWENTY-FIFTH, TWO THOUSAND SEVENTEEN REGARDING BORDER SECURITY AND IMMIGRATION ENFORCEMENT IMPROVE- MENTS.
