BILL NUMBER: S4381 TITLE OF BILL : An act to amend the public health law, in relation to establishing a maximum contaminant level for hexavalent chromium in public drinking water PURPOSE : This bill directs the Department of Health to conduct a health review of the chemical hexavalent chromium or chromium-6 and establish a maximum contaminant level for its presence in public water supplies that is protective of public health. SUMMARY OF PROVISIONS : Section one of the bill would amend the public health law to add a new section 1100-c directing the commissioner of the department of health to conduct a comprehensive health review of the chemical hexavalent chromium or chromium-6 and establish a maximum contaminant level for its presence in public supplies of potable water that is protective of public health. This section further directs the department of health to complete this review as soon as practicable while adhering to existing rulemaking procedures.

BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to establishing a maximum contaminant level for hexavalent chromium in public drinking water THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 1100-c to read as follows: § 1100-C. HEXAVALENT CHROMIUM ALSO KNOWN AS CHROMIUM-6. 1. THE COMMIS- SIONER SHALL CONDUCT A COMPREHENSIVE EXAMINATION OF HEXAVALENT CHROMIUM ALSO KNOWN AS CHROMIUM-6 AND ESTABLISH A MAXIMUM CONTAMINANT LEVEL FOR THE PRESENCE OF ANY HEXAVALENT CHROMIUM IN PUBLIC SUPPLIES OF POTABLE WATER THAT IS PROTECTIVE OF PUBLIC HEALTH. 2. SUCH EXAMINATION AND DRINKING WATER STANDARD FOR HEXAVALENT CHROMI- UM SHALL BE IMPLEMENTED IN ACCORDANCE WITH THE STATE ADMINISTRATIVE PROCEDURE ACT AND BE COMPLETED AS SOON AS PRACTICABLE, INCLUDING IMPLE- MENTATION BY EMERGENCY RULE IF DETERMINED BY THE COMMISSIONER AS NECES- SARY TO PROTECT PUBLIC HEALTH. § 2. BILL NUMBER: S4381A TITLE OF BILL : An act to amend the public health law, in relation to including hexavalent chromium in the list of emerging contaminants PURPOSE : This bill adds hexavalent chromium (Chromium-6) to the list of emerging contaminants. SUMMARY OF PROVISIONS : Section one of the bill adds hexavalent chromium (Chromium-6) to the list of contaminants that must be designated as emerging contaminants by the Department of Health. Section two establishes the effective date of immediately. JUSTIFICATION : Since the discovery of chromium-6 (hexavalent chromium) water contamination in Hinkley, California, by Erin Brockovich there has been broad public and scientific acknowledgement of the harms it presents to human health. Despite this acknowledgement, New York does not have a maximum contaminant level (MCL) for chromium-6 in public water systems.

Paragraph c of subdivision 3 of section 1112 of the public health law, as added by section 1 of part M of chapter 57 of the laws of 2017, is amended to read as follows: c. The commissioner shall, at a minimum, include the following chemi- cals identified as emerging contaminants: 1,4-dioxane; HEXAVALENT CHRO- MIUM (CHROMIUM-6); perfluorooctanesulfonic acid; and perfluorooctanoic acid. § 2.
