BILL NUMBER: S439 TITLE OF BILL : An act to amend the penal law, in relation to the commission of larceny PURPOSE : This bill amends Section 155.05 of the Penal Law to define a crime of larceny as including the aggregate amount of property stolen by a person in a common scheme to defraud SUMMARY OF PROVISIONS : Section 1 amends Subdivision 1 of Section 155.05 of the Penal Law to define larceny as including the aggregate amount of property illegally appropriated to oneself, or a third party, in a common scheme to defraud Section 2 amends Subdivision 2 of Section 155.20 of the Penal Law to define the "value" of property involved in a larceny to include the aggregate market value of all the property taken, obtained, or withheld during a common scheme to defraud Section 3 sets forth the effective date of the law.

PERALTA -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to the commission of larceny THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 155.20 of the penal law is amended by adding a new subdivision 5 to read as follows: 5. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION, IN THE CASE OF MULTIPLE VIOLATIONS OF THE PROVISIONS OF THIS ARTICLE CONSTITUTING A COMMON SCHEME, SUCH VIOLATIONS MAY BE DEEMED TO BE A SINGLE OFFENSE DEFINED IN THIS ARTICLE BASED ON THE AGGREGATE VALUE OF ALL PROPERTY TAKEN, OBTAINED OR WITHHELD FOR ALL SUCH MULTIPLE VIOLATIONS CONSTITUTING A COMMON SCHEME. § 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
