BILL NUMBER: S4408 TITLE OF BILL : An act to amend the public health law, in relation to requests for tests for water contaminants by small public water suppliers PURPOSE OR GENERAL IDEA OF BILL : The purpose of this bill is to allow small public water supplies to request testing for the federally unregulated contaminants designated by the Safe Drinking Water Act. SUMMARY OF PROVISIONS : Section one directs the Department of Health to establish a list of contaminants consisting of the federally unregulated contaminants designated by the Safe Drinking Water Act. Section two provides that any small supplier may request that its water supply or source be tested for any of the listed contaminants. However, the requesting water supplier may not request testing if they have the federal environmental protection agency testing the water supply for contaminants at the same time. Also under section two, the department must conduct testing and provide the results within 90 days of the request. Finally, section two defines a small public water

VALESKY, ALCANTARA, AVELLA, CARLUCCI, HAMILTON, KLEIN, PERALTA, SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requests for tests for water contaminants by small public water suppliers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 1111 to read as follows: § 1111. REQUESTS FOR TESTS FOR WATER CONTAMINANTS BY SMALL PUBLIC WATER SUPPLIERS. 1. THE DEPARTMENT SHALL ESTABLISH A LIST OF CONTAM- INANTS CONSISTING OF THE FEDERALLY UNREGULATED CONTAMINANTS AS DESIG- NATED PURSUANT TO THE FEDERAL SAFE DRINKING WATER ACT (42 U.S.C. § 300G-1). 2. ANY SMALL PUBLIC WATER SUPPLIER MAY REQUEST THAT ITS WATER SUPPLY OR SOURCE BE TESTED FOR THE LIST OF CONTAMINANTS SET FORTH IN SUBDIVI- SION ONE OF THIS SECTION BY THE DEPARTMENT. PROVIDED, HOWEVER, THAT SUCH WATER SUPPLY OR SOURCE IS NOT CURRENTLY BEING TESTED BY THE FEDERAL ENVIRONMENTAL PROTECTION AGENCY OR ANY OTHER FEDERAL AGENCY OR FEDERAL DEPARTMENT FOR SUCH CONTAMINANTS. WITHIN NINETY DAYS OF RECEIPT OF THE REQUEST, THE DEPARTMENT SHALL CONDUCT SUCH TESTING AND PROVIDE THE SMALL PUBLIC WATER SUPPLIER WITH THE RESULTS. THE COST OF SUCH TESTING SHALL BE FUNDED BY THE STATE. FOR THE PURPOSES OF THIS SECTION, A SMALL PUBLIC WATER SUPPLIER SHALL BE DEFINED AS A PUBLIC WATER SUPPLIER WHICH SERVES TEN THOUSAND PEOPLE OR FEWER. 3. THE COMMISSIONER IS HEREBY AUTHORIZED AND DIRECTED TO PROMULGATE RULES AND REGULATIONS NECESSARY FOR THE IMPLEMENTATION OF THIS SECTION. § 2. This act shall take effect on the sixtieth day after it shall have become a law, provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such date.
