BILL NUMBER: S4656 TITLE OF BILL : An act to amend the environmental conservation law, in relation to establishing the plastic bag challenge grant program; and making an appropriation therefor PURPOSE OR GENERAL IDEA OF BILL : To issue a challenge to all New York State colleges and universities to assist in finding a solution to the ongoing issue of plastic bag pollution in New York State. SUMMARY OF SPECIFIC PROVISIONS : The ECL is amended by adding a new section, 27-2715. Subdivision 1 establishes the plastic bag challenge grant program. Subdivisions 2 defines the eligibility in the plastic bag challenge grant program to include all colleges and universities, public and private, located in the state of New York. Subdivision 3 requires proposal be submitted to the commissioner through a procedure established by the commissioner. Subdivision 4 directs the commissioner to select ten schools presenting the ten most feasible proposals. This subdivision also

AVELLA -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the environmental conservation law, in relation to establishing the plastic bag challenge grant program; and making an appropriation therefor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 27-2715 to read as follows: § 27-2715. PLASTIC BAG CHALLENGE GRANT PROGRAM. 1. ESTABLISHMENT OF PROGRAM. THE COMMISSIONER SHALL ESTABLISH THE PLASTIC BAG CHALLENGE GRANT PROGRAM AND INVITE ALL COLLEGES AND UNIVER- SITIES IN THIS STATE TO DEVELOP A PROGRAM PROPOSAL THAT WILL ADDRESS THE ENVIRONMENTAL DANGERS OF PLASTIC BAG USE IN THE STATE BY (A) PROVIDING ALTERNATIVE AFTER-MARKET USES FOR PLASTIC BAGS AND/OR (B) CREATING A BIODEGRADABLE MATERIAL FOR USE IN THE MANUFACTURE OF SUBSTITUTES FOR PLASTIC BAGS SUCH THAT BAGS MADE OF THE MATERIAL WILL NOT POSE A THREAT TO THE ENVIRONMENT. 2. ELIGIBILITY. ALL COLLEGES AND UNIVERSITIES, PUBLIC AND PRIVATE, LOCATED IN THE STATE ARE ELIGIBLE TO APPLY FOR AND RECEIVE THE PLASTIC BAG CHALLENGE GRANT. 3. PROPOSALS. PROPOSALS MUST BE SUBMITTED TO THE COMMISSIONER IN A PROCEDURE TO BE DEVELOPED BY THE COMMISSIONER IN CONSULTATION WITH THE COMMISSIONER OF EDUCATION. 4. INITIAL GRANTS. (A) UPON RECEIPT OF THE PARTICIPANT PROPOSALS THE COMMISSIONER SHALL SELECT THE TEN SCHOOLS THAT HAVE PRESENTED THE TOP TEN MOST FEASIBLE PROPOSALS. THE TEN FINALISTS SHALL THEN EACH RECEIVE A ONE HUNDRED THOUSAND DOLLAR GRANT TO ADVANCE RESEARCH, DEVELOPMENT AND IMPLEMENTATION OF THEIR PROPOSAL. (B) THE TEN SCHOOLS SHALL HAVE NINE MONTHS TO COMPLETE THEIR RESEARCH AND SUBMIT THEIR RESULTS FOR FINAL REVIEW BY THE COMMISSIONER.
