BILL NUMBER: S5060 TITLE OF BILL : An act to amend the public health law, in relation to home care aides PURPOSE : To extend the wage parity law to apply to workers who are employed under the Consumer Directed Personal Assistance Program SUMMARY OF PROVISIONS : Section one of the bill amends paragraph d of subdivision 1 of section 3614-c of the public health law, as amended by chapter 56 of the laws of 2016 to provide that for purposes of this section, that nothing in this paragraph shall be construed to exclude individuals who are employed under the consumer directed personal assistance program. JUSTIFICATION : Most individuals receiving home care in the State through Medicaid are signed up with a home care agency. The agency has licensed home care staff that will go to the consumer's home to provide services. An increasing number of Medicaid recipients now receive their homecare services through another model, the Consumer Directed Personal Assistance Program (CDPAP). In this model, Medicaid patients are

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to home care aides THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (d) of subdivision 1 of section 3614-c of the public health law, as amended by chapter 56 of the laws of 2016, is amended to read as follows: (d) "Home care aide" means a home health aide, personal care aide, home attendant or other licensed or unlicensed person whose primary responsibility includes the provision of in-home assistance with activ- ities of daily living, instrumental activities of daily living or health-related tasks; provided, however, that home care aide does not include any individual (i) working on a casual basis, or (ii) who is a relative through blood, marriage or adoption of: (1) the employer; or (2) the person for whom the worker is delivering services, under a program funded or administered by federal, state or local government. PROVIDED, HOWEVER, THAT FOR PURPOSES OF THIS SECTION, THAT NOTHING IN THIS PARAGRAPH SHALL BE CONSTRUED TO EXCLUDE SUCH INDIVIDUALS DESCRIBED IN SUBPARAGRAPH (II) OF THIS PARAGRAPH EMPLOYED TO PROVIDE THESE SERVICES UNDER THE PROVISIONS OF SECTION THREE HUNDRED SIXTY-FIVE-F OF THE SOCIAL SERVICES LAW. § 2.
