BILL NUMBER: S5204 TITLE OF BILL : An act to amend the not-for-profit corporation law, in relation to the creation of a land bank in a city with eight million or more residents by adoption of a local law by the city council PURPOSE OR GENERAL IDEA OF BILL : To amend the not-for-profit corporation law and allows cities with populations larger than eight million or more residents to create land banks. SUMMARY OF SPECIFIC PROVISIONS : Allows larger cities to create land banks and control formerly owned governmental units. JUSTIFICATION : New York City is in a housing crisis at levels not seen since WWII. This is due impart to many factors, but the biggest burden during this crisis is the cost of land acquisition. This bill will forced New York City to utilize their vacant lots to build truly affordable housing using deeper levels of Area Medium Income Bands through non profit

HAMILTON -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend the not-for-profit corporation law, in relation to the creation of a land bank in a city with eight million or more residents by adoption of a local law by the city council THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph and subparagraph 2 of paragraph (a) of section 1603 of the not-for-profit corporation law, paragraph (a) as added by chapter 257 of the laws of 2011 and subparagraph 2 of paragraph (a) as amended by chapter 372 of the laws of 2013, are amended to read as follows: Any foreclosing governmental unit may create a land bank by the adoption of a local law, ordinance, or resolution as appropriate to such foreclosing governmental unit AND IN ADDITION, ANY CITY WITH EIGHT MILLION OR MORE RESIDENTS MAY CREATE A LAND BANK BY ADOPTION OF A LOCAL LAW BY THE CITY COUNCIL which action specifies the following: (2) the number of members of the board of directors, which shall consist of an odd number of members, and shall be not less than five members nor more than [fifteen] ELEVEN members; § 2. JUSTIFICATION : New York City is in a housing crisis at levels not seen since WWII. This is due impart to many factors, but the biggest burden during this crisis is the cost of land acquisition. Paragraph (g) of section 1603 of the not-for-profit corpo- ration law, as amended by chapter 106 of the laws of 2014, is amended to read as follows: (g) Nothing in this article shall be construed to authorize the exist- ence of more than twenty land banks located in the state at one time, PROVIDED, HOWEVER, THAT A CITY WITH ONE MILLION OR MORE RESIDENTS MAY AUTHORIZE THE EXISTENCE OF NOT MORE THAN TEN LAND BANKS THAT SHALL NOT BE COUNTED AS PART OF THE STATEWIDE TOTAL AT ANY SINGLE POINT IN TIME, provided further that each foreclosing governmental unit or units proposing to create a land bank shall submit such local law, ordinance or resolution as required by paragraph (a) of this section, to the urban development corporation, for its review and approval. The creation of a land bank shall be conditioned upon approval of the urban development corporation. § 2. This act shall take effect immediately.
