BILL NUMBER: S5255 TITLE OF BILL : An act to amend the civil service law, in relation to interdepartmental promotion lists PURPOSE OF THE BILL : This bill would amend the Civil Service Law ("CSL") to authorize the Department of Civil Service ("Department"), upon an agency's request, to certify an interdepartmental promotion list and a departmental promotion list without preference to the departmental promotion list. SUMMARY OF PROVISIONS : Section 1 of the bill would amend CSL § 52(4) to authorize the Department, upon an agency's request, to certify an interdepartmental promotion list and a department promotion list without preference to the departmental promotion list. Section 2 of the bill would make it effective immediately. JUSTIFICATION : New York State's ability to effectively implement public policy and provide critical services relies upon an effectively managed workforce. To this end, this bill would allow agencies to consider

GOLDEN -- (at request of the Department of Civil Service) -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to interdepartmental promotion lists THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 52 of the civil service law, as added by chapter 790 of the laws of 1958, is amended to read as follows: 4. Departmental and interdepartmental promotion lists. The state civil service department and municipal commissions may establish interdepart- mental promotion lists which shall not be certified to a department until after the promotion eligible list for that department has been exhausted, EXCEPT THAT UPON THE WRITTEN REQUEST OF THE APPOINTING OFFI- CER STATING THE REASONS THEREFOR, THE STATE CIVIL SERVICE DEPARTMENT MAY CERTIFY AN INTERDEPARTMENTAL PROMOTION ELIGIBLE LIST AND A DEPARTMENTAL PROMOTION ELIGIBLE LIST WITHOUT PREFERENCE TO THE DEPARTMENTAL PROMOTION ELIGIBLE LIST. § 2.
